      Commonwealth vs Maston PackThis day came the attorney for the commonwealth and the attorney for the defendant, and the defendant Maston Pack appeared in court in ordinance to his recognizance on motion of the attorney for the commonwealth the def was organized and on his arraignment def moved to court to quash the indictment in this case which motion the court overruled and there upon def demurred to the indictment and to each cause thereof in which demurred the attorney for the commonwealth join and this court over turned demure to which ruling of the court is refusing to quash the indictment and in overruling demurred the def expect and there upon the defendant pleaded not guilty and for his trial ??? himself upon the court and the attorney for the commonwealth did likewise thereupon cause a ??? of 16 ??? who had been regularly and ??? summoned for the trail of W.H. Barnett who stood indicted for a felony in this court who were examined on this ??? and all of there were found to be free from exception and qualified in all respects to serve as jurors in the case from whom the defendant struck 4 leaving the following named 12 who ??? contributed the jury for this trail of the case to wit: C.T. Whitman, W.T. Bandy, C.B. Daniel, L Mack Catron, H.S. Lockhart, G.W. Sparks, C.W. Butt, W.E. Brown, James D. Peery, J. Hoge, J.W. Long, Jw. Gill, who were sworn to well and truly try and true deliverance make between the commonwealth and the defendant, Maston Pack and the jury having fully hear the evidence and argument of council received their instructions from the court and retired to their room to consider their verdict and after a time returned into the court and rendered the following verdict. We the jury find the def, guilty as charge within the indictment and fix his penalty at two years in the state penaltentry C.B. Daniel Foreman. Whereupon the jury was discharged from further consideration of the case and their ??? is rewarded ??? to jail and thereupon the persons by his council moved the court to set aside the said verdict and grant him a new trial which motion the court takes into consideration.
