The land was eventually sold at public auction and sold for $61 dollars, and each heir got their share after court costs.

• Murder Trial: 1 Oct 1822, Franklin County, Virginia; Tried and confined to 8 years in the penitentiary for 2nd degree murder. There don't seem to be any court records proceeding this, indicating that William probably lead a quiet life with no other troubles before this. Unfortunately, there are no records showing what brought about the trouble that lead to a murder. Little information has been found about James Parker. Some speculate that he may have been a "drummer" a traveling salesman of the time. A James Parker is found in Franklin court records, marrying Charlotte Cockran Sept. 9, 1818. This may or may not be the murder victim.
• Will: 26 Oct 1822, Franklin County, Virginia; William wrote his will the same day he was sentenced to prison. Research indicates that he was likely taken to Penitentiary Hill (on VA 40 east) rather than the state correctional institution in Richmond.

At a court held for the Franklin County at the Court House the first day of October 1822 for the examination of William Newberry charged with feloniaous homicide in the killing of James Parker in the said County on the twenty second day of September 1822.

(Present) Peter Saunders, Majia Greer Jr. Henry Carper, Edmond Tate and George Memafee--Justices

The said William Newberry was led to the bar in custody of the jailor of the County and thereupon it being demanded of him wheather he's guilty of the offence of which he stands charged or not guilty. Saith that he is in nowise guilty thereof, whereupon the Court proceeded to examine _______, as well in behalf of the Commonwealth as of the prisoner, who was heard by Council in his defence, on consideration whereof it is the opinion of the court that the said William Newberry, for the Homicide aforesaid ought to be tried before the Superior Court of Law of the County at the next term thereof, where upon he is remanded to jail.

John Griffith, Hannah Heard, Ann Parker, Rebecca Parker, Angus McGhee, Abraham Jones and Jacob Sigmon, came into Court and severally acknowledged themselves to be indebted to his Excellency, Thomas M. Randolph Esquire, Governor or Chief Magestrate of the Commonwealth of Virginia, in the sum of one hundred dollars each of their respective lands and tenements, goods and chattels to be levied and to the said Governor and his succesors for the use of the Commonwealth reserved, yet upon this condition that if the said John Griffith, Hannah Heard, Ann Parker, Rebecca Parker, Angus McGhee, Abraham Jones and Jacob Sigmon shall make their personel apperance here before the Judge of the Superior Court of Law of this County on the first day of the next term of the said Court to give evidence in the behalf of the Commonwealth touching the felonious Homicide with which William Newberry is charged and shall not depart hence, without the leave of the said Court, then this Recogonizance to be void.

Newberry Arraignment and Sentencing, Part 2, 1822 - Franklin Co. VA

At a Superior Court of law for Franklin County continued and held at the Courthouse the 26th day of October 1822

Present (The same judge as on yesterday)

William Newberry late of the County, labourer, who stands convicted of murder in the second degree was again brought to the Bar in custody of the keeper of the Public jail of this County, and thereupon it being demanded of him if anything for himself he had or knew to say why the Court to Judgment and execution against him of and upon the premises should not proceed and nothing being offered or alleged in delay of judgment therefore it is considerered by the Court that the said William Newberry be imprisoned in the Publick Jail and Penitentiary house of this Commonwealth for the term of Eight years the period by the Jurors aforesaid in their verdict ascertained and that he be kept in solitary cell in the said Jail and Penitentiary house on low and coarse diet for the space of one twelfth part of the said term.

And it is ordered that the Sheriff of this County do as soon as possible remove and safely convey the said William Newberry from the jail of this County to the said Publick Jail and Penitentiary house,therein to be kept imprisoned and treated in the manner directed by the act entitled, an act to reduce unto one act the several acts and parts of Acts for establishing a Penitentiary house and for the punishment of crimes.

And in pursuance of the said Act the Court doth certify that nothing appeared to the Court either in aggravation or extenuation of the offense of the said William Newberry nor did it appear before the said commission of the said murder that he was of a bad or good character or had ever been tried.

William appears to have died in the penitentiary (or on his way to it?), and he seems to have recognized before his sentencing that this was likely to occur.

He was tried on 1 October 1822, and sentenced on 26 Oct 1822 to 8 years in the penitentiary, with the first 8 months of that time in solitary confinement with a bread and water diet. Recognizing his likely fate, shortly before his sentencing, William gave power of attorney to William Boyd, which was the name of both his son-in-law, and the son-in-law's father, who was a nearby neighbor of Newberry's.


Will:
When William wrote his will, he was likely was likely preparing for his sentence or had just been sentenced. Found on the same pages as the will in the Clerks office are land transactions conveying land to daughter Sarah (25 Acres) and son Levi (a tract).

Know all men by these present that I, William Newberry of the County of Franklin and State of Virginia, have ordained, nominated and appointed, and by these present do hereby nominate, constitute and appoint Samuel Saunders and William Boyd of the said County and State my true and lawful attornies in fact, for the purpose of selling and disposing of my estate goods and effects, real and personal on such terms and in such manner as they may think most conductive to my interest and to make deeds of conveyance therefore to the purchaser or purchasers, to demand and receive the entire proceeds of such sale or sales, to collect all debts that may be due me and grant receipts and acuittances for the same, and to apply the proceeds thereof when collected to the payment of all my just debts.

And my said attornies are hereby desired in the first place, to dispose of my personal property and if sufficient for that purpose to pay and satisfy all claims against me, and in that case my attornies will permit my son Thomas Newberry to live upon the land rent free, during the term of his life, but if the money arising from the sale of the personal estate shall not be sufficient to pay and satisfy all just claims agaisnt my, my attornies will dispose of the land, and apply the proceeds thereof to that purpose, and the balence if over, my attornies after my death will divide equally among my children.

If it shall not be necessary to dispose of my land for the purposes of paying my debts, my attornies will after my death dispose of the same, and divide the money arising from such sale equally among my children.

And I hereby give unto my said attorneys above named full, general and unlimited powers for the transaction of the matters and things above mentioned, and I do hereby ratify and confirm to all intents and purposes whatever they may do in the premises by virtue hereof, Witness my hand and seal this 26th day of October 1822.

The 1824 Land Tax List is the first to identify William Newberry as deceased, suggesting he died between late spring of 1823 and late spring of 1824, while incarcerated.

John Vier of Franklin in the State of Va who was a private in the (blank) commanded by Captain (blank) of the Regt. commanded by Col. Taylor in the Va line for 2 years

Inscribed on the Roll of Virginia at the rate of 60 Dollars __ Cents per annum, to commence on the 4th day of March, 1831.

This day Hardin Woods came before me a magistrate for the County aforesaid and made oath that John Via served as a private soldier in the Virginia line under the Command of Col. Francis Tailor, Given from under my hand this the 21st day of October 1820. W.J. Freeland J.P. Buckingham County

State of Virginia; Franklin County - On this 24th day January 1834 Personally appeared before me Samuel Saunders a Justice of the Peace for the Said County

John Via a Resident of the County of Franklin and State of Virginia aged 76 years who being first duly Sworn according to law doth on his Oath make the following declaration in Order to obtain the benefit of the Provision made by the Act of Congress passed June 7th 1832.

That he enlisted in the army of the United States for term of three years in the County of Amherst Virginia under Capt. Jesse Allen who being deprived of the Command he was Transferred to Capt. Solmon Rice and upon the resignation of Capt. Rice he was marched under the command of Captain Burton in a detachment of the Virginia line Commanded by Colonel Francis Taylor to guard the Prisoners surrendered by Burgoyne; that he was marched and counter marched through the north western part of the State of Virginia and quartered at different Times near the Towns ___ ___ ___ at the warm Springs Shepards town and Martinsburg and being discharged at Winchester Virginia.

Having lost his discharge that he Served the Whole term that he enlisted for, at the different places States as Private Soldier.

He hereby relinquishes every claim whatever to a pension or an annuity except the Present and he declares that his name is not on the Pension roll of any agency in any State or If any, only on that of the Said agency of the State of Virginia.

John Vier (his mark) Franklin County State of Virginia, Viz, Personally appeared before me a Justice of the Peace for the County aforesaid John Via who being duly Sworn deposeth and Saith that by reason of old age and the consequenth loss of memory he cannot Swear Positively as to the Precise Time of his enlistment or the Time of his discharge Nor the Precise Time of his Service at each place that he was Quartered, that he Served - the Period of three years as mentioned as Private Soldier and for Such Service I claim Pension.

On this the 21st day of January 1843 personally appeared before me James Cannaday a justice of the peace, and as such one of the justices of the County Court of Franklin County & State of Virginia the same being a court of record, Sarah Viah, alias Sarah Vyer, a resident of said County & state, aged about ninety five or ninety six years, who being first duly sworn according to Law, doth, on her oath, make the following declaration in order to obtain the benefit of the provision made by the Act of Congress passed July 7th, 1838:

That she is the widow of John Viah, alias John Vyer, who was a soldier in the Army of the Revolution, and who was enlisted as she has understood by Jesse Allen whose rank she does not know, nor does she know in what corps or regiment he was enlisted. She further states that she has frequently heard her husband speak of his enlistment and services during the Revolutionary War, and particularly of his being detailed to guard a certain body of prisoners to the town of Winchester in this state.

Though her recollection is so much affected by age that - she cannot call to mind the circumstance & events detailed by her husband - She knows however that he served during a considerable portion of the war and that a short time before his death he established his claim to a pension under the Act of Congress, and refers to the evidence furnished by her husband of his services and which she supposes are now on file in the pension office at Washington, and which on account of her husbands death, and her age, and ignorance of her rights heretofore she cannot now furnish again.

She further states she was married to the said John Viah, alias John Vyer on the 4th day of March 1784, that her husband the aforesaid John Viah died on the 7th day of March 1834, and that she has remained a widow ever since that period, as will fully appear by reference to the proof hereto annexd. witnesseth that for and in consideration of the Sum of Fifteen pounds Lawful money of Virginia to him the said John Peek in hand paid by the said John Via Senr the Receipt whereof he the sd Peek doth hereby Acknowledge have given granted Bargained & Sold and by these Presents doth Grant Bargain Sell deliver and Confirm unto him the said John Via Senr one Certain Tract or Parcel of Land Situate Lying and being in the County of Franklin and on the South fork of Runnett Bag Creek Joining said Peeks lines on the West by a new Division line Begining at a white oak in Peeks and James Cannadays lines thence nearly South two
hundred and twenty poles to a Red Oak in sd old Mead line Between sd Peek and John Heard & thence Round as it meanders nearly West to the first Station on a Corner White Oak and Containing one hundred Acres more or less to have and to hold the said tract or Parcel of Land together with its appurtenances unto the said John Via Senr his heirs or assigns and the said John Peek doth further agree with the said John Vier Sr to Warrant and forever defend the said tract or parcel of Land from the Claims of all Persons unto the said Vier Sr his heirs and assigns in fee simple.

To have and to hold the above Granted Land and premises unto the said John Vie his heirs and assigns for Ever and said William Renfro for him and hisheirs covenant and agree and with the said John Vie & his heirs and

Exam'd Robert Brooke Esquire Governor of the Commonwealth of Virginia to all to whom these presents shall come Greeting Know Ye that by Virtue of two Land Office Treasury Warrants Numbers twelve thousand six hundred and sixty six, issued the twenty eight day of June one thousand Seven hundred and eighty two, and fourteen thousand two hundred and twenty seven, issued the thirteenth day of September one thousand seven hundred and eighty two.

There is granted by the said Commonwealth unto John Via Senior a Certain tract or parcel of Land Containing Seventy five Acres by survey bearing date the thirtieth day of October one thousand Seven hundred and ninety three, lying and being in the County of Franklin, on the North side of Runnett Bagg Creek, and is bounded as followeth to Wit:

Beginning at a Maple on said Creek in John Peeks line, and with it, North ten degrees West twenty eight poles crossing said Creek to 4 white oak in James Canadys line, and with it North twenty five degrees East seventy six poles to a red oak, thence new lines south fifty eight degrees East sixty eight poles to a white Oak south six degrees West sixty poles to a dogwood south forty two degrees East eighteen poles to a Spanish Oak South twenty two degrees West one hundred and eight poles to a Spanish oak, South thirty five degrees East fourteen poles to a white oak in Samuel Underwood's line, and with it, South forty degrees West Sixteen poles to a poplar on the Creek, and up the same as it meanders to the first station, with its appurtenances to have and to hold the said tract or parcel of Land with its appurtenances to the said John Via Senior and his Heirs forever.

I John Via Sen of the County of Franklin and State of Virginia being week of body but of good sound mind and mental facilities, and knowing that is appointed unto men once to die, have made and constituted this my last will and Testament, and Revoking all others that have been made by me.

And first I resign my soul to God who gave it, and my body to the Earth from whence it was taken in full assurance of its resurrection at the last day, and as my worldly estate, which it has pleased God to bless me with,

I give and bequeath unto my beloved wife Sarah Via, all my lands, Stock of every description household and kitchen furniture, and every other article to have and to hold the same during her natural life and at her death, I will that my Daughter Sarah Newberry have a certain tract or parcel of land which has been recently marked off in the presence of witnesses, Viz: Beginning on Ingram's line on a corner white oak and Gum on the west Side of the Ridge, thence a Straight line a north course to John Via, Jr. corner Spanish oak on the same ridge to her the same during her life and then to heirs of her body __

To also Seventy acres sold William Morris Seven acres sold John Arrington which was sold by the said David Austin and not intended to be conveyed by this Indenture to have and to hold the above granted land and premises and all appurtenances belonging thereto the said Isaac Via his heirs and assigns and the said Josias Via for himself and his heirs executors administrators or assigns doth covenant and agree to and with the said Isaac Via his heirs and assign the aforesaid land and premises in fee Simple State and the Land.

• Surety: 1813, Franklin County, Virginia, USA; Surety for Marriage of Margaret Martin and William Newberry (also ancestors). Is it possible his sister "Molly" was Margaret & Molly a nickname. Usually a nickname for Mary, but was also more rarely, Margaret.

According to info by his son Hezekiah, said his father died of "old age" on 7 Sep at age "80 yrs 7 mo & a few days" the 7 mo & few days would correspond w/above birthday, but years conflict. Hezekiah was probably incorrect as to the age.
