THIS DEED, made and entered into this 15th day of March, 1955, by and between Fannie D. Ray and Early W. Ray, her husband, parties of the first part, and Sherman Woodrow Burress and Virginia Alice Burress,his wife, parties of the second part.
WITNESSETH:that for and in consideration of the sum of Five Thousand Ten Dollars ($5,010.00), of which consideration of sum of Ten Dollars ($10.00) is this day cash in hand paid, receipt of which is hereby acknowledged by the parties of the first part, the remaining Five Thousand Dollars ($5,000), being evidenced by a certain negotiable, promissory note, dated the 15th day of March, 1955, payable to the order of Fannie D. Ray, at Richlands, Virginia, in the principal amount of Five Thousand Dollars ($5,000.00) made and executed by the aforesaid Sherman Woodrow Burress and Virginia Alice Burress, as makerers, with interest from date at the rate of 6% per annum on the unpaid balance, said principal and interest being payable in 132 monthly installment of $51.84 each, commencing on the 15th day of May, 1955, and continuing on the 15 day of each month thereafter until fully paid, the said Fannie D. Ray and Early W. Ray, her husband, parties of the first part, do hereby grant, bargain, sell and convey, to the aforesaid parties of the second part, Sherman Woodrow Burress and Virginia Alice Burress, his wife, with covenants of General Warranty of Title, with appurtenances and privileges thereunto belonging, all those two (2) certain lots, pieces or parcels of land, situated in Tazewell County, Virginia, and which are designated as Lots Nos. SIXTY-EIGHT (68) and SIXTY-NINE (69) in Block No. FOUR (4) as show on that "Certificate and Plat of Goldie M. Johnson's subdivision of 20.16 acres of land, situated east of the Town of Cedar Bluff, in Tazewell County Va., and which plat and certification are of record in the Clerk's Office of the said County in Deed Book No. 164, page 69, and referenced to which is here made for further particulars and the provisions thereof; and the foregoing being the same and indentical real estate which the female grantor herein, Fannie D. Ray, acquired from T.J. Davis and Mrs. T.J. Davis, his wife, by deed dated the 1st day of September, 1953, and which is of record in the aforesaid Clerk's Office in Deed Book 218, page 91, reference to which is here made.There are excepted and reserved, however, from this conveyance, the water, water rights, privileges and property, in so far as they are or may be applicable to the property hereby conveyed, which were excepted and reserved in the deed which conveyed such real estate, from H.w. Bane and wife to Goldie M. Johnson, which is of record in the said Clerks Office in Deed Book 163, page 301 and which are also excepted and reserved in the said certification and plat.It is further understood and agreed by and between the parties hereto that the said Sherman Woodrow Burress and Virginia Alice Burress will have and keep the dwelling house located on said real estate insured against loss and damage by fire in the sum of at least $4500.00, until the balance of the purchase money is fully paid, with loss payable or mortage clause attached to the policy of insurance in favor of Fannie D. Ray, as her interest may appear, the same being as additional security for the payment of said debt.A vendor's lien is hereby expressly reserved and retained upon the real estate hereby conveyed to secure the payment of the deferred purchased money note herein
before described, with the interest which may become due thereon.The note herein above described waives the homestead exemption and provides for the payment of 10% attorney's fees if placed in the hands of an attorney at law for collection, which said note also provides that if as many as five installments thereof are not paid at the time and place specified, the entire unpaid principle sim and accrued interest shall at once become due and payable without notice at the option of the holder thereof, but failure to exercise such option shall not constitue a waiver of the right to exercise the same in the event of any subsequent default.Witness the following signatures and seals
