    To the Hon. R. C. Jackson, Judge of the Circuit Court of Tazewell County, Virginia:

    Your oratrix, Lula J. Hicks, would respectfully represent unto your Honor that on the 26th day of October, 1897, she sold to one J. W. Burress a house and lot in the Town of Graham, Va., at the price of Three Hundred Dollars of which amount the said Burress paid your oratrix One Hundred Dollars; and for the residue he executed to your oratrix two bonds of One Hundred Dollars each, one of which was payable Two years after date; and the other was payable One year after date; each with interest from the date of sale, Oct. 26th, 1897. Since the execution of the said notes or bonds, the said Burress has paid on the first note due some very small payments; all of which are endorsed on the back of the first bond due; and the residue is wholly unpaid, although the said Burress has repeatedly been called on for payment.

    Your oratrix has a good and sufficient title to the said property; and she files herewith her deed to the said property to the said J. W. Burress, to be treated as an escrow in this cause, to 003 delivered to the said J. W. Burress only when he shall have fully paid the residue of the purchase money, and the costs of this suit. She also files herewith the two said bonds as exhibits.

    Your oratrix prays that the said J. W. Burress be made a party defendant to this bill, and required to answer the same, but not on oath, that being waived; and that your oratrix have a decree for her money; and that said house and lot, which is known as the John P. Kelly property be sold to pay the same. And she prays for general relief. And as in duty bound, she will ever pray, &c. Lula J. Hicks. J. W. Hicks, counsel for the Complainant.

    In the Circuit Court of Tazewell County, Virginia: To the Hon. Fulton Kegley, Judge of the Circuit Court of the said County: Humbly complaining your Oratrix, Orgie Burress, would respectfully represent that on the ---- day of-------19l4, she bought from the Graham Land & Improvement Company, in Graham, through Walter Graham, its President, a lot of land in what is commonly called South Graham, on the opposite side of the road that passes by the residence of her father, J. W. Burress.

    This road is the main thoroughfare leads from the said Town of Graham to and intersects with the main Cumberland Turnpike road near the residence of Mrs. Vicie A. Burress, and which has been recently macadamized out of the bond issue road money of Tazewell county; and is a road that has a great deal of travel over it.

    For the lot in question your Oratrix was to pay the Graham Land & Improvement Company the sum of Two Hundred and Fifty Dollars; but, if she paid all cash she was to have a discount of Eighteen Dollars.

    Shortly thereafter she sent the said Walter Graham a check on the Bank of Graham for this Two Hundred and Fifty Dollars, expecting him to return to her the said Eighteen Dollars when the said check was cashed.

    The said Walter Graham obtained the cash the said check in a very short time thereafter; but to date he has never returned to her the said Eighteen Dollars.

    Your Oratrix took possession, under this purchase, of the said lot, and had the same enclosed by a wire fence and she promptly applied to the said Graham Land & Improvement Company, and the said Walter Graham, it's President, for a deed to the said lot.

    And although she has made repeated demands on them for her deed, she has thus far failed to get any satisfaction. At the time she made the contract in question, it was agreed between your Oratrix and the said Walter Graham that the said lot was to be 60 feet in width, and was to face and front on the before named street from the North, and was to run back between parallel lines, at right angles to the said street, that width, to the line of J. W. Hicks, near the top of a hill that lies just North of the said street, and on the side of which hill the said lot is located, thus making the said lot about 305 feet in length.

    This lot lies just west of and adjacent to the West line of Mr. Frank Cook; but is longer than his said line.

    Your Oratrix was very particular with Mr. Walter Graham to have a distinct understanding with him that the lot in question was to run straight up this hill.

    When your Oratrix applied to him for a deed, he informed her that he was having the said hillside laid off into lots; and that as soon as he got this done, he would make her a deed.

    He did have this land laid off into lots: but he did not run them straight up the hill, as was agreed; but he ran them so as to run up this hill in a very slanting manner, and in such shape that no man in his right mind would have them.

    He then made and tendered to your Oratrix a deed to one of these lots; but it did not convey the land she had bought, and she refused to accept it.

    At this juncture he admitted that there had been a mistake made in making this survey and map; and he said he would have a correct survey made, and make a correct map of it, and make a correct deed.

    Whether he ever made this map or not your Oratrix does not know; but he did make a small map of the said Frank Cook lot; and he laid off a lot West of and adjacent to this lot, making it 56.25 feet wide on the front, and 56.25 feet on the rear, and only 120.7 feet in length; and he thereby did not run it back to the aforesaid Hicks line.

    He then made another deed to this lot thus laid out; and tendered it to your Oratrix; but as it did not comply with her contract with him, she refused likewise to accept this new deed.

    Since that time she has not been able to get him to do anything, one way or the other; and he refuses to make her a correct deed.

    The lot in question should front the street mentioned, bordering on the North side thereof, of the width of 60 feet, and should run straight up the hill that width, between parallel lines, N. 17 45 E. 305 feet to the Hicks line, the Easterly line thereof bordering on the westerly line of the said Frank Cook lot.

    Being without remedy, save in a Court of Equity, your Oratrix comes into this court and prays that the Graham Land & Improvement Company be made a party defendant to this Bill, and required to answer the same, but not on oath, that being waived; that a proper survey be made of the lot in question, according to the terms of the purchase herein set forth; that a commissioner be appointed by this court to convey the same to your Oratrix; and that this be done at the costs of the defendant Graham Land & Improvement Company.

    And she prays for all such other, further and general relief as to a Court of Equity may seem proper; And as in duty bound she will ever pray, & c. Orgie Burress, By Counsel.J. W. Hicks, Counsel for Complainant.

    Orgie Burress vs. Graham Land & Improvement Company. Enter this decree this May 27th, 1915.

    This cause came on again to be heard upon this 27th day of May 1915, upon the bill and exhibits therewith filed, and on the demurrer heretofore filed therein, and the joinder therein by the complainant.

    Thereupon the complainant moved the court to allow her to amend the said bill, which said amendment was allowed by the court, and was made by inserting in the said bill the following amendment: "and since this bill was filed your oratrix has broken up the ground of the entire lot, planted the same, and now has a growing crop upon the entire lot.

    And thereupon the defendant renewed its demurrer to the said bill as amended, and the court having heard the argument on the said demurrer, it is adjudge, ordered and decreed that the said demurrer be and it is hereby sustained, and that said bill be and it is hereby dismissed, and that the defendant recover of the plaintiff its costs in this suit. (something hand written after this, but unreadable).

    A number of Grahamites, including several ladies, enjoyed a big fox chase on East River Mountain Tuesday night. Grace Hall was chosen master of hounds and the dogs were not long in finding a good trail. The chase lasted an hour when the fox went to earth near the big bluffs under the brink of the mountain. It WaS the first experience at chasing for some of the ladies but they enjoyed the fun immensely. Those in the party were Mrs. J.W Moore, Misses Orgie, Ida and Jessie Burress, Marue Scott, Mandeline Trout, Gertrude and Mabel Rucker, Billie and Marie Hall and Edna Kelster and Donald Sanders, Ray Hart, Verny Burress, Bob Greever, Walter Keister, A.G. Hall and Amos Wade.

    E.T. Brown, Charles Townsley, James Belcher, John Upton, Jess Cabell, Will Rose, Robert Crocker, Tom Smith and W.E. Cook of the B.R.T at Hinton, accompanied the remains of B.G. Burress from Hinton to Graham and attended the funeral at the latter place yesterday.

    Bluefield Daily Telegraph, January 24, 1906

    The funeral of B.G. Burress took place at Graham in the presence of a large number of friends and relatives. The services were conducted by Rev. Mr. Davis and Mr. Steele. the following members of the Hinton Brotherhood of Train: L.F Cabell, C.L. Townsiev, I.P. Upton, B.F. Corker, W. Rose, O.P. White, R. Sensley and I.D. Wade, and a large delagation ofrom the Bluefield lodge attended. The Hinton lodge contributed a hansome floral brakewheel.

    Mr. Burress was aged 28 years, two months and seven days. He joined the Christian church in 1896 and has been a consistent member since. He loved railroading and thought he could do nothing else. He possessed a forgiving spirit and it did not matter what kind of treatment he received he could forgive and forget. He also possessed a spirit of giving and gave literally to all who were needy.

A writing dated the 23rd day of December, 1948, purporting to be the last will and testament of Josephine Burress Cooke, was this day presented in the Clerk's Office of the Circuit Court of Tazewell County, Virginia, by Clyde C. Cooke, son, who is named therein as Executor and Trustee thereof, and offered for probate. It appearing from the evidence introduced that the said Josephine Burress Cooke died on the 4th day of June, 1962; that at the time of her death, she had a known place of residence in Tazewell County, Virginia, and owned real and personal property therein. Thereupon came Paul. S. Hudgins, one of the subscribing witnesses to said writing, who, after being duly sworn, stated that the said writing was signed and acknowledged by the said Josephine Burress Cooke as and for her last will and testament in his presence, and in the prescience of B. M. Newman and Virginia Mae Armes, the other subscribing witness thereto, all four being present together at the same time, and that he, the said Paul S. Hudgins, and B.M. Newman and Virginia Mae Armes, signed their names thereto as subscribing witness at the request of the said Josephine Burress Cooke and in her presence and in the presence of each other, all four being present together at the same time, and that in his opinion, the said Josephine Burress Cooke was of sound mind at the time thereof. It, therefore, appearing that the said writing was properly executed as a will is required to be executed under the law and that the same has been legally proven, the same is hereby admitted to probate and ordered to be recorded as and for the last will and testament of Josephine Burress, Cooke, deceased. Thereupon, Clyde C. Cooke, son and who is named in said writing as Executor and Trustee thereof, moved that he be appointed Executor and Trustee under the last Will and testament of Josephine Burress, Cooke, deceased, which motion was granted, and the said Clyde C. Cooke is hereby appointed Executor and Trustee under the Last Will and Testament of Josephine Burress Cooke, deceased. Thereupon, Clyde C. Cooke qualified as such Executor and Trustee by taking and subscribing the oath required by law and by entering into bond in the penalty of Six Thousand (6,000.00) Dollars, without surety, said bound being payable and conditioned according to law, the said testatrix having requited in said will that no security be required of him. On motion of Clyde C. Cooke, Executor and Trustee, as aforesaid, and it appearing from the evidence introduced that Josephine Burress Cooke owned no personal property other than a small amount of household and personal effects of a value of approximately $50.00, no appraisers are appointed to appraise said estate. Given under my hand this 2nd day of July, 1962 Rhea F. Moore, Jr. Clerk Virginia: In the clerk's office of the Circuit court of the County of Tazewell: Estate of Josephine Burress Cooke, deceased. I, the undersigned, who this day qualified before the Clerk of the Circuit Court of the County of Tazewell as Executor and Trustee under the last will and testament of Josephine Burress, Cooke, deceased, late of the County of Tazewell, Virginia, on my oath do say that I have made diligent inquiry and that I believe the following to be a true and correct list together with the ages and addresses of the heirs of my decedent, Josephine Burress, Cooke, who died in testate on June 4, 1962.     Death of Mrs. Hattie Burress Jennings Occurred Yesterday Morning.

    Mrs. Hattie Burress Jennings died yesterday morning after a short illness of scarlet fever. She was married on the 4th of last December at Ironton, Ohio, to A.E. Jennings, bookkeeper for the Flat Top Grocery Company and the young couple were quite popular. She was the daughter of Mr. and Mrs. J. Wesley Burress, of Graham, and made her home in that town until her marriage, when she came to this city and the young couple took up their residence at 407 Scott Street. The deceased was a member of the Methodist church. She will be buried in the West Graham Cemetery at 2:30 this afternoon, the funeral taking place from her late home at 1 o'clock with religious services at the grave. Mrs. Burress is the first of those who have become ill with scarlet fever to die during the recent scare. How she contacted the disease is unknown.

    In addition to her parents, she was preceded in death by her siblings: George Compton, Phyllis Coates, Barkley, Barry and Clifton Burress.

    Those left to cherish her memory are her children: Tim Bane (Christina) of Grundy, VA, Tommy Bane, David Bane both of Bluefield, VA, Pam Murphy (John) of Bluefield, WV, Robin Fulp (Wayne) of Catawba, VA; sister: Nancy Downs of Louisville, KY; grandchildren: Ashley Bane, Melissa Bane, Jonathan Murphy, Kelli Rutherford, TC Bane, Emily Hurt, Corey, Lauren, Macie and Ashton Fulp; great-grandchildren: Addison Clements, Kolton Murphy, Caden Neel, Magdalene Cecelia Rutherford and Kenneth Blake Rutherford, Jr.

    A service to celebrate Barbara's life will be held Wednesday, May 31, 2017 at 12:00 noon at Dudley Memorial Chapel with Rev. Lacy Brooks officiating. Burial will follow at Maple Hill Cemetery. Wayne Fulp, John Murphy, Corey Fulp, Jonathan Murphy and Roger Burress will serve as pallbearers.

    Friends may visit with the family, Tuesday, May 30, 2017 at Dudley Memorial from 6-8 P.M.

    The family would like to thank Westwood Nursing Home and staff for the love and care they gave Mrs. Barbara the past 2 years.

    Barbara married Hallie Clifton Bane on 27 Oct 1951 in Bluefield, Tazewell County, Virginia, and was divorced on 21 Oct 1976 in Tazewell County, Virginia. Hallie was born on 12 Aug 1932 in Tazewell County, Virginia; died on 6 May 2005 in Roanoke, Virginia. [Group Sheet] [Family Chart]
