Witnesseth: that for and in consideration of the sum of one hundred dollars ($100) paid and to be paid as hereinafter set out, the parties of the first part do hereby, bargain, grant, sell and convey, with convenants of general warranty of title, unto the said R.H. Burress and Frances Burress, his wife, parties of the second part, all of those certain lots or parcels of land situate, lying and being in Baptist Valley, in Tazewell County, Virginia, together with all improvements thereon and appurtenances thereunto belonging, and designated as Lots Fifteen (15) and Sixteen (16) as shown a a map identified as "Sub-division of the Gus Payne farm situated in Baptist Valley, Tazewell County, Virginia"
which map is attached to and made a part of a deed from J.A. Payne and Ella Payne, his wife, to Kathleen Payne, dated even date herewith and to be forthwith recorded in Clerk's Office for Tazewell County, Virginia, and being a part of the same real estate conveyed to the said Gus Payne by Minervia V. The consideration for this conveyance is the sum of one hundred dollars ($100), as hereinabove stated, of which amount the sum of Thirty-Three and 33/100 dollars ($33.33) is cash in hand paid, the receipt of which is hereby acknowledged, and the balance of said consideration, being the sum of sixty-six and 67/100 ($66.67), is evidence by three negotiable interest bearing notes, dated April 15th, 1939, executed by the said J. Ed Bandy and payable to the order of J.A. Payne at the Farmer's Bank of Clinch Valley, Tazewell Virginia, in one (1), two (2), and three (3) years, respectively, after date, with interest from date at the rate of six per cent per annum, until paid; the first two of said notes being in the sum of Twenty-two and 22/100 dollars ($22.22) each, and the third and last of said notes being in the sum of Twenty-two and 23/100 dollars ($22.23)

These said notes are to be taken over and redeemed by the said parties of the second part. It is understood and agreed between the parties hereto that the parties of the first part do hereby expressly reserve a vendor's lien on the lots of land herein conveyed to secure the payment of the deferred purchase money notes hereinabove described.

Witnesseth: That for one dollar cash in hand paid by the parties of the second part to the parties of the first part, the receipt of which is hereby acknowledges, and other consideration as hereinafter set forth, the said parties of the first part do hereby grand, sell and convey, with covenants of general warranty of title, unto the said Byrd P. Burress and Ella Burress all those two certain lots or parcels of land, together with all improvements thereon and appurtenances thereunto belonging, situated and being in Baptist Valley, in Tazewell County, Virginia designated and described as Lots No 15 and 16 on that certain map or plat entitled: sub-division of the Gus Farm situate in Baptist Valley, Tazewell County, Virginia: which said map or plat is attached to and recorded with a certain deed from J.P. Payne and wife to Kathleen Payne, of record in the Office of the Clerk of Circuit Court of Tazewell County, Virginia, reference to which is here made for a more complete description of the property hereby conveyed; and being the same real estate which was conveyed to the grantors herein by J. Ed Bandy and Blanche Bandy, his wife, by deed dated the 24th day of July, 1939 and recorded in the aforesaid Clerk's Office in Deed Book 145 page 306 reference to which is also made for a more complete description of the property hereby conveyed.

Reserving, however, unto the grantors, and to the survivor of said grantors, so long as either of said grantors may live, a life estate in said lots or parcels of land hereby conveyed.

It is expressly understood between the parties hereto that there is a Vendors Lien subsisting against this property to secure certain deferred installments of the purchase price owing to J.A. Payne as set forth and mentioned in the aforesaid deed from J. Ed Bandy and wife. Of the notes therein mentioned, the last two in the principal sum of $22.22 and $22.23, respectively, are unpaid and outstanding.

The parties of the second part, by their acceptance of this deed, do hereby assume the payment of the said unpaid deferred purchase money, as evidence by the notes aforesaid, witness the following signatures and seals.

Both his obit and his death certificate says Hankins Cemetery, and that is where his 2nd wife Frances is buried.

But Earls Cem, Earls Branch, Tazewell Va is where living relatives say that he was buried, and Patrica Christian (Raleigh's granddaughter) says she remembers going to the funeral when she was 14.

There is no stone at either place for him.

Second: All the balance and residue of my property, both real and personal, I do give, devise and bequeath to my daughter, Gloria June Nuckels, to be hers absolutely and in fee simple, but subject to this proviso: that should my said daughter, Gloria June Nuckels, precede me in death, then and in that event only, all the balance and residue of my property, both real and personal, shall pass equally, share and share alike, to my other children, namely: John Shortridge, Grace Rimmer, Bill Shortridge, Nannie Houchins, Pansy Damron, I.C. Shortridge, Thelma Joyce, Anne Blevins, Raymond Shortridge, Mae O'Byrne and Robert Shortridge.

Third: I do appoint my daughter, Gloria June Nuckels, as Executrix of this my last will and testament; and, I do direct no security be required of her as Executrix hereof upon her qualification.

A writing dated the 14th day of December, 1966, purporting to be the last will and testament of Sarah M. Shortridge was on the 28th day of March 1967, presented in the Clerk's Office of the Circuit court of Tazewell County, Virginia, by Gloria June Nuckles, daughter of Sarah M. Shortridge, and offered for probate. It appearing from the evidence introduced that the said Sarah M. Shortridge died on the 13th day of Mary, 1967: that at the time of her death she had a known place of residence in Tazewell County, Virginia, and owned real property therein. Thereupon came Emma Mabe, one of the subscribing witnesses to said writing, who, after being duly sworn, stated that the said writing was signed by placing her mark thereon, and acknowledge by the said Sarah M. Shortridge as and for her last will and testament in her presence, and in the presence of Gloria June Nuckles, the other subscribing witness thereto, all three being present together at the same time, and that she, the said Emma Mabe, and Gloria June Nuckels signed their names thereto as subscribing witnesses at the request of the said Sarah M. Shortridge and in her presence and in the presence of each other, all three being present together at the same time, and that in her opinion, the said Sarah M. Shortridge was of sound mind at the time thereof. It, therefore, appearing that the said writing was properly executed as a will is required to be executed under the law and that the same has been legally proven, the said writing is hereby admitted to probate and
ordered to be recorded as and for the last will and testament of Sarah M. Shortridge, deceased.

Whereupon, on this 30th day of March 1967, again came Gloria June Nuckels, who is named in said writing as Executrix thereof, and declined to act as such Executrix, and moved no personal representative be appointed to administer said estate; and it appearing from the evidence introduced the Sarah M. Simpkins, Justice, issued a warrant the 10th day of December, 1934, directed to Lick Puckett (?) of said County and delivered the same ? to Lick Puckett (?) of McDowell County, West Virginia.

Upon the 10th day of December, 1934, said Lick Puckett (?) executed said warrant by bringing before me, R.L. Simpkins, Justice aforesaid, at my office in said County and District, Big Creek, the above named defendant.

Now on this 10th day of December, 1934, the defendant being arraigned his plea is that he is guilty ?? Proceeded to try the case.

Charging that her husband, E.H. Burress, had "beaten me up." Mrs. Bessie Burress, of Welch, had Magistrate H.W. Herndon of Welch issue a warrant for his arrest Tuesday. Officers lodged him in jail to await a hearing before the magistrate.

Former Countian Reported Killed In Fort Worth, Texas Emory H. Burress, 37, former resident of McDowell County, now in the army, was instantly killed in an automobile accident at Fort Worth, Texas, Saturday afternoon, according to word received here over the weekend.

No details of the accident were received other than that the car was struck by a train, at a railroad crossing, killing Mr. Burress and injuring two women.

Born in Tazewell County, Mr. Burress was employed for a few years by the Carter Coal Company, at Caretta, and later worked for a railroad company at Huntington. He had been in the west the past few years.

He is survived by his father, Raleigh H. Burress of Cedar Bluff; four brothers, Sherman and Byrd, at Richlands, Va.; Ernest, at Caretta; and Perry Vernon, who is in the service. He also is survived by three sisters, Mrs. Tyler Bledsoe of Squire, WV and two sisters in Baltimore, Md. and a son, Vernon, who is in the US Navy.

This day came the state by her attorney and the prisoner, Emery Hamilton Burress, in person and by counsel, was set to the bar of the court in custody of the keeper of the jail of this county and thereupon the prisoner demurred to and moved the court to quash the indictment against him herein and the court after maturely considering said demurrer and motion to quash doth overruled the same.

Georgia E. (Burress) Frank, 88, of Glen Rock, died Friday, Jan. 23, 2004, at Hanover Hall Nursing Center, Hanover. She was the wife of the late William F. Harman and the late Louis E. Frank. Mrs. Frank was born on April 15, 1915, in Richlands, Va., a daughter of the late Raul and Cannie Mae (Combs) Burress. Formerly of Baltimore, she lived in the Glen Rock area since 1992 and she was a member of the Shrewsbury Baptist Church. She leaves a son, William G. Harman Sr., of Glen Rock, four grandchildren and five great grandchildren. She was predeceased by a son, Terry L. Harman. Funeral services will be held at 10 a.m. Wednesday at the Geiple Funeral Home Inc., 53 Main St., Glen Rock. Burial will be in Moreland Park Cemetery, Baltimore. A viewing will be held from 7 to 9 p.m. Tuesday at the funeral home. Officiating at the service will be Pastor Richard Bishop.

Mrs. Broughman was born on June 4, 1912, Tazewell, Virginia. She was the daughter of the late Henry P. Burress and Mary Frances Quesenberry Burress. She was a homemaker all her life and was a member of the Galatia Presbyterian Church. She was also a member of the Women of the Moose Chapter 22 in Clifton Forge, VA. Mrs. Broughman is survived by three daughters; Virginia Colley Nichols and husband James, Carrell Colley Crowder and husband Loyd, and Ruth Anne Colley Williams and husband Gerry; a daughter-in-law, Fran Colley; ten grandchildren; fourteen great- grandchildren; 1 great great grandchild; and a number of nieces and nephews. In addition to her parents, Mrs. Broughman was preceded in death by her first husband Stanford Colley, her second husband, William Broughman; her son, Thomas Colley; four sisters, Blanche Rasnake, Pearl Shaw, Margaret Basham, and Helen Whitt; four brothers, James Burress, Bill Burress, Luther Burress, and George Burress. A graveside service will be conducted at 2:00 PM, Friday, August 24, 2007 at Alleghany Memorial Park, Low Moor, with the Reverend Charlie Johnson officiating. Born to the late Henry and Mary Frances Quesenberry Burress in Cedar Bluff, Va., he spent the past 40 years residing in Tazewell County, Va. A veteran of World War II, he served with honor aboard the Destroyer Escort, VSS Lamons (Class DE-743). Upon returning home, he completed studies at West Virginia Business College and conferred his degree with the Class of 1946. He retired as finance manager from the former Pat's Pontiac and GMC in Doran, Va. Never one to be idle, he continued working part time for the Tazewell Farmer's Livestock Market as well as supporting local VFW Post 7136 of Tazewell, Va. He was an avid bowler and golfer and enjoyed both as his favorite pastimes. In addition to his parents, he was preceded in death by six brothers and six sisters. Survivors include his wife of 53 years, Virginia E. Beavers Burress; daughter, Joy Mulkey and husband, Jim, of Maxwell; son, James P. Burress and wife, Jenny, of Rural Retreat, Va.; grandchildren, Scott Burress, Christy Burress and Jordan Lowe-Mulkey; two sisters, Gray Braughman of Florida and Blanche Rasnake and husband, Campbell, of Cedar Bluff; and two special family friends, Chris Smiley and Amandda Tirey. Mr. Emory I. Quesenberry, 69, of Pounding Mill, died in a Richlands hospital Friday afternoon, Oct. 27, following a brief illness. He was born in Tazewell County and was a son of the late George and Mary Burress Quesenberry, both Tazewell County Natives. He was a retired radio and T.V. repairman. He had made his home in the Richlands area his entire life. He had served in the U.S. Army and was a veteran of WWII. He was preceded in death by his wife, Mrs. Myrtle Tate Quesenberry December 31, 1977. Survivors include five sisters, Mrs. Robert Maxfield and Mrs. Tom Lowe, both of Tazewell; Mrs. Sylvia Lambert, Mrs. Bill Hoover and Mrs. Bill Helmandollar, all of Bluefield; five brothers, John Quesenberry of Richlands, Fred Quesenberry of Tazewell, Byrd Quesenberry of Dallas TX, Herbert Quesenberry of Cedar Bluff and Wilburn Quesenberry of Houston TX. Funeral services were conducted Sunday afternoon at the Hurst Scott Funeral Home chapel with Rev. Clyde Sparks officiating. Interment followed in Greenhills Memory Gardens at Claypool Hill. Nephews served as pallbearers.

William Ira (Bill) Burress, 63, of the Pea Patch section of Jewell Ridge, died Thursday Nov. 1, in a Richlands hospital after a long illness. Born at Jewell Ridge, he was a son of the late John William and Rose Griffits Burress, both Tazewell County natives. A retired miner, he was formerly employed by Jewell Ridge Coal Co, at Jewell Valley and was a member of UMWA Local Union No. 7327 at Jewell Valley. He had made his home in the Jewell Ridge area most of his life and was a member of the Oak Grove Church of Christ near Whitewood. Three brothers preceded him in death. Survivors include his widow, Mrs. Roma E. The birth date and place of birth on this card are incorrect. My father tried to first get drafted so lied about his age. When they didn't draft him, he enlisted himself in the Navy at age 14. 9 months later when the navy found out he was under age, they discharged him.

Enlistment:
Dad was on his own since he was 13. With no place to go he lied about his age and enlisted in the Navy at the age of 14. He made it 8 months before they found out his true age and discharged him. When he turned 18 he enlisted with the Marines.

He was a retired electrician and a World War II Navy Veteran and Korean Conflict Marine Veteran. He was a member of IBEW Local #553 and the American Legion Post #155 of Crystal River, Fla. He was a protestant. Surviving are his wife; Shirley A. Burress of Crystal River, Fla., two sons; Edward Burress of Gloucester, Va, and Gregory Burress of Homosassa, Fla., one daughter; Michelle Burress of FL and six grandchildren. Private cremation will take place. Brown Funeral Home, Crystal River - Lecanto.
