The Shortridge vs. Tizens cases are the outcome of an automobile collision which occurred at the point where the road from the county farm intersects Route 19 a short distance east of the Tazewell corporation line on August 10 1941. Sarah Shortridge claims damage for personal injury to the extent of $5,000 and Henry Shortridge $10,000.

I, Sarah M. Shortridge, a resident of Richlands, Tazewell County, Virginia, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my last will and testament, hereby revoking all wills by me at any time heretofore made.
First: I direct that all my just debts be paid, if I shall owe any at the time of my death, including funeral expenses and any hospital or doctor bills.
Second: All the balance and residue of my property, both real and personal, I do give, devise and bequeath to my daughter, Gloria June Nuckels, to be hers absolutely and in fee simple, but subject to this proviso: that should my said daughter, Gloria June Nuckels, precede me in death, then and in that event only, all the balance and residue of my property, both real and personal, shall pass equally, share and share alike, to my other children, namely: John Shortridge, Grace Rimmer, Bill Shortridge, Nannie Houchins, Pansy Damron, I.C. Shortridge, Thelma Joyce, Anne Blevins, Raymond Shortridge, Mae O'Byrne and Robert Shortridge.
Third: I do appoint my daughter, Gloria June Nuckels, as Executrix of this my last will and testament; and, I do direct no security be required of her as Executrix hereof upon her qualification.
IN WITNESS WHEREOF, I hereunto subscribe my name and affix my seal to this my last will and testament, this the 14th day of December 1966.

IN RE: PROBATE OF LAST WILL AND TESTAMENT OF SARAH M. SHORTRIDGE, DECEASED.
A writing dated the 14th day of December, 1966, purporting to be the last will and testament of Sarah M. Shortridge was on the 28th day of March 1967, presented in the Clerk's Office of the Circuit court of Tazewell County, Virginia, by Gloria June Nuckles, daughter of Sarah M. Shortridge, and offered for probate. It appearing from the evidence introduced that the said Sarah M. Shortridge died on the 13th day of Mary, 1967: that at the time of her death she had a known place of residence in Tazewell County, Virginia, and owned real property therein. Thereupon came Emma Mabe, one of the subscribing witnesses to said writing, who, after being duly sworn, stated that the said writing was signed by placing her mark thereon, and acknowledge by the said Sarah M. Shortridge as and for her last will and testament in her presence, and in the presence of Gloria June Nuckles, the other subscribing witness thereto, all three being present together at the same time, and that she, the said Emma Mabe, and Gloria June Nuckels signed their names thereto as subscribing witnesses at the request of the said Sarah M. Shortridge and in her presence and in the presence of each other, all three being present together at the same time, and that in her opinion, the said Sarah M. Shortridge was of sound mind at the time thereof. It, therefore, appearing that the said writing was properly executed as a will is required to be executed under the law and that the same has been legally proven, the said writing is hereby admitted to probate and
ordered to be recorded as and for the last will and testament of Sarah M. Shortridge, deceased.
Whereupon, on this 30th day of March 1967, again came Gloria June Nuckels, who is named in said writing as Executrix thereof, and declined to act as such Executrix, and moved no personal representative be appointed to administer said estate; and it appearing from the evidence introduced the Sarah M. Shortridge at the time of her death owned no personal property, no personal representative is appointed to administer said estate. Given under my hand this the 30th day of March, 1967
