On Dudley's birth record, it lists his father as David Earls. One a deed of Samuel's, he is listed as D. Samuel Earls, so it's possible his first name is David, and he just went by Samuel.

The deposition of Samuel Earls taken on the 29th day of August 1866 at the Clerks Office of Tazewell Circuit Court before the undersigned a commissioner in chancery for the said court:

Q: Do you know of the defendant Mary Bowman's having sexual intercourse with any person except her husband?

Samuel Earls: I saw enough to satisfy me that she had sexual intercourse with other persons besides her husband.

Q. By same, at what time and with whom did she have illicit intercourse.

Samuel: In the year 1863 with one Charles Lawson. I watched them and saw them go to bed together and am satisfied that they had illicit intercourse.

And further this despondent saith not.

Samuel Earls Deed October 19, 1866

This deed made this 19th day of October 1866 A.D. between Joseph Harrisson of the first part and Samuel Earls of the other and second part, both parties of County of Tazewell, State of Virginia:

Now I, Joseph Harrisson of the first part do and doth deed covey and deliver unto Samuel Earls of the second part a general warrenty deed and title and right to himself and heirs, assigns +c to two tracts or parcels of land for the valuable consideration of one hundred and fifty dollars paid by the said Samuel Earls of the second part unto the said Joseph Harrison of the first part the receipt whereof is hereby acknowledged. The lands lay in the County aforesaid.

One tract or parcel by grand in the name of William Christian for Sixty Five acres which bears date the 1st day of August 1850; And the other tract or parcel of land by grant for forty acres patent or grant in the name of David Christian and the Forty acres which bears date the 30th day of October, One thousand eight hundred thirty eight on the waters of Indian Creek of Clinch River and the back fork of Sandy both tracts or parcels of land join.

This deed made this 24th day of July 1872 between Bird L. Bruster and Elizabeth Bruster of the first part and Samuel Earls of the second part, all of the county of Tazewell and State of Virginia, Witnessith;

That in and for the consideration of the sum of three hundred and fifty dollars paid by William B???? to the parties of the first part in hand the receipt thereof is hereby acknowledged, do grand, bargain and convey to the party of the second part, him the party of the second part having accounted to the said William B???? the full amount of three hundred and fifty dollars and him holding the bond by purchase with legal assign by purchase of the same do grant and convey to the party of the second part a certain tract of parcel of land lying and being in the county of Tazewell and state aforesaid on the waters of the Clinch River where on the party of the second part now resides it being the entire interest agreed on and conveyed by all the lawful heirs, Robert Barnett, deceased, to the party of the first part and bounded as follows:

Beginning at white oak corner to James Barnett and James Bruster and with said Bruster line to corner of F.K. Asbury and with Asbury line to William P. Watkins line and with the same to James Barnetts west line and with the same to the beginning. ???? to contain sixty five acres be the same more or less, the said party of the first part consents to warrant the lands hereby conveyed generally. This deed made this 25th day of July 1872 between Samuel Earls and Amanda, his wife, of the first part and William W. Bandy of the second part, all of the County of Tazewell and State of Virginia. Witnesseth;

That for and in consideration of the sum of three hundred dollars, paid in hand to the said Samuel Earls, the said Earls, doth bargain and sale the William W. Bandy a certain tract or parcel of land, containing one hundred and five acres more or less, lying and being in the County of Tazewell and State of Virginia, lying in the gap on the divider between the waters of Indian Creek and the beech fork, and bounded as follows to wit:

Beginning at a chestnut at 60 E. 126 poler to a beech, 2 chestnuts to locust near a coal bank, N 21 W. 28 poles to a sow wood and chestnut, N. 13 E. 20 poler, adjoining the beech fork to a gum, N. 33 W. 9 poler to a maple and dogwood. S 54 W 130 poler to two white oaks, S 26 E. 36 poler to the beginning.

Beginning at a poplar, black oak, chestnut and dogwood on a hill side near two large rocks on the side next to the beech fork at 30 W 60 1/4 poler, adjoining a spur and branch to a hickory, cucumber, fair poler in the north west side of said branch N. 68 W. 58 poler to 2 dogwoods and cucumber on a spur near Thomas S. Christians line, S. 63 W. 60 poler to a double poplar and dogwood on a hill side. S. 20 E. 100 poler to 2 chestnut stumps, N. 77 E. 37 poler adjoining a drain on the waters of the gap branch to a white oak on the side of a spur. This indenture made this 1st day of August 1883, between Samuel Earls & Manda, his wife of the one part and William L. Watkins of the other part, all of the county of Tazewell and state of Virginia.

Witnessith; that the said Samuel Earls & Manda, his wife for and in consideration of two hundred dollars, twenty dollars of which is paid by W.L. Watkins, the receipt whereof is hereby acknowledged, have granted bargained and sold and by these present do grant bargain and sell unto the said W.L. Watkins a certain tract parcel on boundary of land lying and being in said county of Tazewell on _____ Ridge containing (25) twenty five acres be the same more or less and bounded as follows:

Beginning at a fallen black oak and old corner between Samuel Earls and W.L. Watkins and James Barrett and running about a Rod month (?) to a Locust thence with top of Ridge to an old chestnut tree, thence with top of Ridge to a chestnut and sourwood, thence with top to a Locust, thence with top to a white oak thence with top to a chestnut thence with top of ridge to a dogwood on or near Watkins corn field fence, at the upper or south side of his horse shoe bend the whole line running with top of ridge in a south westerly direction, thence with old line between said Watkins and said Samuel Earls, back to the beginning at the fallen black oak.

To have and to hold the said land with all its appurtenances unto the said William L. Watkins his heirs and assigns forever and the said Samuel Earls for himself, his heirs executions and administrators does by these present covenant with the said W.L. Watkins his heirs + c so defend against the claim or claims of all and every person.

Mr. Dudley P. Earls, 84 years of age, died Sunday night at his home in Cliffield, where he was born and reared. Funeral services were conducted at the home Tuesday afternoon, the service being in charge of the Rev. Clarence Greenleaf, of Grundy. Burial in the family cemetery near his home. Mr. Earls is survived by nine children: James S. Earls, of Salem, Va.; Clarence Earls, of Bluefield; Tom Earls, of Baptist Valley; Dewey Earls, of Orange, Texas; Joe Earls, of Coulwood Va; Mrs. C.L Young of Cucumber; Mrs. Mary Boothe, of Tazewell; Mrs. Fannie Massie of Cliffield and Mrs. Ella Saunders of Cliffield. His wife and five children preceded him in death. There also survives 45 grandchildren; 29 great grandchildren; and one sister, Mrs. George Brewster, of Pounding Mill.

Pounding Mill - About 4 PM, Monday, July 7, the death angel came quietly and claimed for its own Mrs. Martha SHAMBLIN, wife of our townsman, H.E. SHAMBLIN.

She had been ill of dropsy for almost a year, and her death was not unexpected. She was a Miss EARLS, before marriage, and was twice married, her first husband being Mr. Bird BRUSTER, who proceeded her to the grave several years ago. She was born May 4, 1866 (?), and married to H.E. SHAMBLIN, November 31, 1915. Her funeral was preached at the Ringstaff cemetery on Tuesday at 4 PM by her pastor, T.S. HARRIS, of Red Ash, assisted by Rev. Johnson FURROW, Christiansburg, of Church of God, in the presence of a large number of relatives and friends. Ten flower girls carried the many beautiful floral tributes. Mrs. SHAMBLIN many times told her relatives and friends that she was ready and gave instructions for her burial and funeral. Much sympathy goes out to the bereaved ones. "Blessed are the dead who die in the Lord." Among the persons who attended Mrs. SHAMBLIN'S funeral and burial here were her five brothers in law, the SHAMBLIN brothers and their wives, Mr. and Mrs. EARLS and many others.

On Monday afternoon about 5 o'clock the three room cottage belonging to Mrs. Joseph PRUETT and occupied by her son, Peery, was burned. Although Mrs. PRUETT was in the next room, entertaining a relative, the entire household effects, except a washing machine, at the kitchen door, were consumed. The origin of the fire is unknown, as there had been no fire in the room for a few days. The room was covered with several thicknesses of paper and burned rapidly. Friends and relatives have made them up a nice little purse.

Witnesseth: that for and in consideration of the sum of one hundred dollars ($100) paid and to be paid as hereinafter set out, the parties of the first part do hereby, bargain, grant, sell and convey, with convenants of general warranty of title, unto the said R.H. Ed Bandy and Blanche Bandy, his wife, by deed dated the 24th day of July, 1939 and recorded in the aforesaid Clerk's Office in Deed Book 145 page 306 reference to which is also made for a more complete description of the property hereby conveyed.

Reserving, however, unto the grantors, and to the survivor of said grantors, so long as either of said grantors may live, a life estate in said lots or parcels of land hereby conveyed.

It is expressly understood between the parties hereto that there is a Vendors Lien subsisting against this property to secure certain deferred installments of the purchase price owing to J.A. Payne as set forth and mentioned in the aforesaid deed from J. Ed Bandy and wife. Of the notes therein mentioned, the last two in the principal sum of $22.22 and $22.23, respectively, are unpaid and outstanding.

The parties of the second part, by their acceptance of this deed, do hereby assume the payment of the said unpaid deferred purchase money, as evidence by the notes aforesaid, witness the following signatures and seals.

Both his obit and his death certificate says Hankins Cemetery, and that is where his 2nd wife Frances is buried.

But Earls Cem, Earls Branch, Tazewell Va is where living relatives say that he was buried, and Patrica Christian (Raleigh's granddaughter) says she remembers going to the funeral when she was 14.

There is no stone at either place for him.

Shortridge was on the 28th day of March 1967, presented in the Clerk's Office of the Circuit court of Tazewell County, Virginia, by Gloria June Nuckles, daughter of Sarah M. Shortridge, and offered for probate. It appearing from the evidence introduced that the said Sarah M. Shortridge died on the 13th day of Mary, 1967: that at the time of her death she had a known place of residence in Tazewell County, Virginia, and owned real property therein. Thereupon came Emma Mabe, one of the subscribing witnesses to said writing, who, after being duly sworn, stated that the said writing was signed by placing her mark thereon, and acknowledge by the said Sarah M. Shortridge as and for her last will and testament in her presence, and in the presence of Gloria June Nuckles, the other subscribing witness thereto, all three being present together at the same time, and that she, the said Emma Mabe, and Gloria June Nuckels signed their names thereto as subscribing witnesses at the request of the said Sarah M. Shortridge and in her presence and in the presence of each other, all three being present together at the same time, and that in her opinion, the said Sarah M. Shortridge was of sound mind at the time thereof. It, therefore, appearing that the said writing was properly executed as a will is required to be executed under the law and that the same has been legally proven, the said writing is hereby admitted to probate and
ordered to be recorded as and for the last will and testament of Sarah M. Shortridge, deceased.

Whereupon, on this 30th day of March 1967, again came Gloria June Nuckels, who is named in said writing as Executrix thereof, and declined to act as such Executrix, and moved no personal representative be appointed to administer said estate; and it appearing from the evidence introduced the Sarah M. Robert Lee Bandy, 84, of Route 1, Bandy, died Nov. 13, in an Abington Hosptial. His death was attributed to natural causes. He was a son of the late Thomas C. and Maggie Pruett Bandy. He was a native of Tazewell County and had lived most of his life at Dix Creek. He was a member of the Dix Creek Advert Christian Church where he had served as Sunday School superintendent and song leader for many years. He was a retired employee of the Pocahontas Fuel Co. Five brothers and two sister preceded him in death. Surviving are one sister, Mrs. Ruth Sizemore of Bandy, and several nieces and nephews. Funeral services were conducted Nov. 15 at 11 am from Peery and St. Clair Funeral Home Chapel in Tazewell with the Rev. Carl Gross and the Rev. Leonard Lester officiating. Burial followed at the Grandview Memory Gardens on the Bluefield Tazewell Road. Nephews served as Pall bearers.

He was born in Tazewell County and was a son of the late Clarence Levi and Hannah Harrison Earls, both Tazewell County natives. He had been a life long resident of the Cliffield-Pounding Mill area.He was a retired miner, a former employee of the Clinchfield Coal Corp at Moss No. 2 Mine. He was a member of the United Mine Workers of America, Local Union No. 1098 at Clinchfield.He was a member of the Cliffield Christian Church. One son Ronald Earls, preceded him in death.Survivors include his wife, Edith Valentine Rasnake Earls; five daughters, Frances Earls of the home, Mrs. Randall (Hannah) Sluss of Centreville, Mrs. Benny (Deborah) Bandy of Route 1, Cedar Bluff, and Mrs. Dale (Judy) Lowe and Mrs. Charlie (Gussie) Hankins, both of Cedar Bluff; three sons, Donald Earls of Glen Burnie, MD. Harrison Earls, Jr. of Jessup MD and Robert C. (Bobby) Earls of Richlands; three sisters, Claudia Hankins of Route 1, Cedar Bluff and Ruth Smith and Gussie Butcher, both of Caretta WV; one brother, Benny Earls of Colorado Springs, Co. 11 Grandchildren also survive. Funeral Services were conducted Monday morning, June 7, at the Hurst-Scott Funeral Chapel in Richlands with Rev. Glen Dudding officiating. Interment followed in the Harrison Cemetery at Cliffield. Pallbearers were: Kenneth Earls, Dorsey Lee Whitt, Bob Carner, Ralph Cochran, Jimmy Shannon, Monroe Pruett and Cecil Cox. Honorary pallbearers were: Dr. James H. McVey, Rev. Charles Guthrie, Carl Harrison and Joe Earls.

Simpkins, Justice, issued a warrant the 10th day of December, 1934, directed to Lick Puckett (?) of said County and delivered the same ? to Lick Puckett (?) of McDowell County, West Virginia.

Upon the 10th day of December, 1934, said Lick Puckett (?) executed said warrant by bringing before me, R.L. Simpkins, Justice aforesaid, at my office in said County and District, Big Creek, the above named defendant.

Charging that her husband, E.H. Burress, had "beaten me up." Mrs. Bessie Burress, of Welch, had Magistrate H.W. Herndon of Welch issue a warrant for his arrest Tuesday. Officers lodged him in jail to await a hearing before the magistrate.

Former Countian Reported Killed In Fort Worth, Texas Emory H. Burress, 37, former resident of McDowell County, now in the army, was instantly killed in an automobile accident at Fort Worth, Texas, Saturday afternoon, according to word received here over the weekend.

No details of the accident were received other than that the car was struck by a train, at a railroad crossing, killing Mr. Burress and injuring two women.

Born in Tazewell County, Mr. Burress was employed for a few years by the Carter Coal Company, at Caretta, and later worked for a railroad company at Huntington. He had been in the west the past few years.

He is survived by his father, Raleigh H. Burress of Cedar Bluff; four brothers, Sherman and Byrd, at Richlands, Va.; Ernest, at Caretta; and Perry Vernon, who is in the service. He also is survived by three sisters, Mrs. Tyler Bledsoe of Squire, WV and two sisters in Baltimore, Md. and a son, Vernon, who is in the US Navy.

Georgia E. (Burress) Frank, 88, of Glen Rock, died Friday, Jan. 23, 2004, at Hanover Hall Nursing Center, Hanover. She was the wife of the late William F. Harman and the late Louis E. Frank. Mrs. Frank was born on April 15, 1915, in Richlands, Va., a daughter of the late Raul and Cannie Mae (Combs) Burress. Formerly of Baltimore, she lived in the Glen Rock area since 1992 and she was a member of the Shrewsbury Baptist Church. She leaves a son, William G. Harman Sr., of Glen Rock, four grandchildren and five great grandchildren. She was predeceased by a son, Terry L. Harman. Funeral services will be held at 10 a.m. Wednesday at the Geiple Funeral Home Inc., 53 Main St., Glen Rock. Burial will be in Moreland Park Cemetery, Baltimore. A viewing will be held from 7 to 9 p.m. Tuesday at the funeral home. Officiating at the service will be Pastor Richard Bishop.

Mr. Burress was an employee of the Jewell Ridge mines, and was on his way to work when his car overturned, killing him instantly. He is survived by his parents, Mr.& Mrs. H.P. Mrs. Whitt, who was born in Virginia, lived in Mount Vernon before moving to Spencer 17 years ago. She was a member of the Bethany Baptist Church in Layfayette. Surviving are two daughters, Mrs. Fay Davis, Spencer and Mrs. Bernice O'Byrne, Mount Vernon, a son Charlie, Chicago, ILL; ten grandchildren and ten great grandchildren. Mrs. Gray "Betty" Colley Broughman, age 95, of Zellwood, Fl died Monday, August 20, 2007 in Eustis, Florida.

Mrs. Broughman was born on June 4, 1912, Tazewell, Virginia. She was the daughter of the late Henry P. Burress and Mary Frances Quesenberry Burress. She was a homemaker all her life and was a member of the Galatia Presbyterian Church. She was also a member of the Women of the Moose Chapter 22 in Clifton Forge, VA. Mrs. Broughman is survived by three daughters; Virginia Colley Nichols and husband James, Carrell Colley Crowder and husband Loyd, and Ruth Anne Colley Williams and husband Gerry; a daughter-in-law, Fran Colley; ten grandchildren; fourteen great- grandchildren; 1 great great grandchild; and a number of nieces and nephews. In addition to her parents, Mrs. Broughman was preceded in death by her first husband Stanford Colley, her second husband, William Broughman; her son, Thomas Colley; four sisters, Blanche Rasnake, Pearl Shaw, Margaret Basham, and Helen Whitt; four brothers, James Burress, Bill Burress, Luther Burress, and George Burress. A graveside service will be conducted at 2:00 PM, Friday, August 24, 2007 at Alleghany Memorial Park, Low Moor, with the Reverend Charlie Johnson officiating. Pallbearers will Mrs. Broughmanâ??s grandsons. The family receive friends Thursday evening from 6:00 PM until 8:00 PM at Nicely Funeral Home, Clifton Forge. MAXWELL, Va. -- James I. Burress, 77, passed on Monday, May 28, 2001, at Tazewell Community Hospital. Born to the late Henry and Mary Frances Quesenberry Burress in Cedar Bluff, Va., he spent the past 40 years residing in Tazewell County, Va. A veteran of World War II, he served with honor aboard the Destroyer Escort, VSS Lamons (Class DE-743). Upon returning home, he completed studies at West Virginia Business College and conferred his degree with the Class of 1946. He retired as finance manager from the former Pat's Pontiac and GMC in Doran, Va. Never one to be idle, he continued working part time for the Tazewell Farmer's Livestock Market as well as supporting local VFW Post 7136 of Tazewell, Va. He was an avid bowler and golfer and enjoyed both as his favorite pastimes. In addition to his parents, he was preceded in death by six brothers and six sisters. Survivors include his wife of 53 years, Virginia E. Beavers Burress; daughter, Joy Mulkey and husband, Jim, of Maxwell; son, James P. Burress and wife, Jenny, of Rural Retreat, Va.; grandchildren, Scott Burress, Christy Burress and Jordan Lowe-Mulkey; two sisters, Gray Braughman of Florida and Blanche Rasnake and husband, Campbell, of Cedar Bluff; and two special family friends, Chris Smiley and Amandda Tirey. Graveside services will be conducted at 2 p.m. Thursday, May 31, 2001, at Greenhills Memory Gardens Mausoleum in Claypool Hill, Va., with the Rev. Max Linkous officiating. Members of Barns-Beavers VFW Post 7136 of Tazewell will conduct military graveside rites. Relatives and friends will serve as pallbearers.
