    Alexander Gibson qualifies as Admin for his deceased father, Daniel Gibson, Elizabeth, the relict having refused.

    Court:
    Hemp crops were common in the 18th century. Hemp fibers are exceptionally strong and durable, and in an era before science could do better, that made this a commodity worth growing.

    Custody of GC:
    Morton's Annals of Bath, referring to the adoptions of William's children by their grandfather Gibson, says he "absconded" It is believed the word is too ? and was used in-advisedly, since the records show he was in touch with his family after that time. The adoption papers refer to him as "having moved out of the colony."

    Died:
    She was not mentioned in her father's will of 1782, so she died before that time. Her last child, Daniel was born in 1769, and William McFarland was found in Wolf Creek by 1771, and Alexander Gibson and petitioned the court of custody of the children, saying their father was gone and they were not being properly cared for. So I'm assuming Elizabeth died between 1770 and 1775.

    Other notes on James claim he paid Wister at one time 279 bear skins, deer skins and ginseng; that he was in Philadelphia PA in the fall of 1800 to buy goods; that he drove cattle and wagons north; as did other merchants; that he was a great Jefferson man; that he was referred to as Major McFarlene and also as Colonel McFarlene; and that he was sheriff of Russell County for several terms. Most interesting letters, filed as exhibits, are coped into the court record. His home was Rosedale and he and his family are buried in the garden there.


    Notes on James. Col. James McFarland, buried in an old cemetery one mile west of Rosedale in Russell Co. VA, "Colonel James McFarlene died 3/24/1830 ate 63 years. One of the first 6 justices of Russell County, VA court in 1810. Major in 1st battalion and 72 Regiment in State Militia. Member of VA House of Delegates starting in 1799. 1798 he was an administrator and attorney for father William. Was a Colonel in the US Army, but resigned his commission. Excerpt from letter written by Samuel McGuire to the Governor of VA 16 April 1812: In compliance with this duty and under the impression that an appeal to arms is inevitable, I take the liberty of reiterating to your excellency a tender of services made to the Executive of Va in 1810 on receiving the appointment of Major in a Regiment of Volunteer riflemen to have been commanded by Colonel McFarland. Excerpt from letter dated 8/23/1807 James McFarland to Governor. "It is with great pleasure I lay before your excellency the proceedings of the 72 Regiment, conveyed on Wednesday last, for the purpose of detailing one captain, on Lieutenant, on ensign and 85 men, her quota of the 11,563 to be furnished by the state. The meeting was more numerous that upon any former occasion, and the utmost harmony prevailed.

    I, James McFarlane of the County of Russell and State of Virginia do hereby make my last will and testament in manner and form following; that is to say 1st I devise all my just debts and funeral expenses to be paid out of my perishable property.

    2ly I give to my son James M. McFarlane, Elizabeth McFarlane and Malinda McFarlane all my personal estate including my slaves to be equally divided between them.

    3ly I give to my son James M. McFarlane all my lands in the County of Russell State of Virginia aforesaid and all the buildings thereon with this exception, that the said Elizabeth and Malinda shall have the privilege of living in my house until they get married the aforesaid lands buildings, et. I give to the said James M. McFarlane his heirs forever.

    4-thly I give all my lands in the County of Tazewell State aforesaid to my son James M. McFarlane, Elizabeth McFarlane and Malinda McFarlane, with this exception that Eleanor Neal and her daughter Mary Neal, shall have a life estate of the bent of the creek whereon they now live, they the said James M. McFarlane, Elizabeth and Malinda to have and to hold said lands to be equally divided between them to them and their heirs forever.

    5-thly I give to my son Alexander One dollar to be paid by James M. McFarlane

    6-thly I give to my daughter Clarissa Kendrick one dollars to be paid by the said James M. McFarlene

    In a County Court, continued and held for Russell County on the 12th day of August 1830. This instrument of writing was exhibited in court as and for the last Will and Testament of James McFarland, deceased and proven by the oath of Joseph Shoemaker and John Burk.

    ***James McFarlane did not disinherit his sons Alexander and Augustus, having given them their portion previously, "15 March 1812 James McFarlene gives land to Alexander for the love and affection he has for him." ***"5 April 1819 James McFarlene gives land to Augustus for the affection he has for him." He probably gave his daughter, Clarissa Kendrick, her part, too, before he made his will in 1825.
