This Indenture, made the sixteenth day of July in the year of our Lord, one thousand eight hundred and forty four between James Burrass (sic) and Franky, his wife of the County of Tazewell and State of Virginia of the one part and George P. Thompson of the same County and State of the other part.

Witnesseth: that whereas the said James Burrass is justly indebted to George W. Browne in the just and full sum of nineteen dollars and forty six cents, the payment of which with interest the said Burrass is willing and desirous, effectually to assure and secure to the said Browne.

This Indenture therefore witnesseth, that the said Burrass and Franky, his wife, as well in consideration of the premises aforesaid as of one dollar to him in hand paid by the said Thompson, the receipt whereof is hereby acknowledged the said James Burrass and Franky his wife, have granted, bargained and sold, and by these presents do grant bargain and sell unto the said George P. Thompson, all the right, title, interest and claim of them, the said James Burrass and Franky, his wife, in and to the real estate of Alexander Neel, deceased, the said Franky being a daughter of said Alexander Neel and as such entitled to the eighth part of his estate, with all the appurtenances.

To have and to hold the said interest in said parcel of land, with all the appurtenances unto the said Thompson and his heirs, to the sole use and behoof of the said Thompson and his heirs, and the said James Burrass and Franky his wife, for themselves and their heirs, the said right, title and interest in the said parcel of land, with all the appurtenances to the said Thompson and his heirs against the claim of them the said James Burrass and Franky his wife, and their heirs, and all other persons whomsoever shall, will and do by these present warrant and forever defend, in trust, never the less, that if the said James Burrass, his heirs, executors or administrators, do and shall well and truly pay or cause to be paid to the said George W.G. Browne, his heirs or assigns the said sum of nineteen dollars and forty six cents on or before the 16th day of December next together with the expenses of drawing and recording this indenture and the tax thereon, then and in that case, this indenture, and everything herein contained shall become void and of no effect;

But if the said Burrass shall fail to pay the said sum of money or any part thereof, on or before the said 16th day of December, next, then it shall be lawful for the said Thompson, and full power and authority is hereby given him to proceed to sell the said interest and claim in said parcel of land with all the appurtenances, so soon after the said 16th December next as he may be requested by the said Browne, at public auction for ready money, to the highest bidder, at Tazewell Court House, having previously advertised the time and place of sale at least twenty days by advertisement affixed for that space of time to the front door of said Court House and the proceeds of such sale after paying thereout all the expenses attaining the execution of this trust including a commission of 5 percent on the amount of sale to the said trustee for his trouble in executing the same shall be applied by the said Thompson towards the discharge and payment to the said Browne of the aforesaid sum of nineteen dollars and 46 cents, with interest on so much of said sum with interest as may remain unpaid, and in further trust, that until such sale shall be made it shall be lawful for the said Burrass and wife, and their heirs, to hold and occupy the said granted interest in said land and premises and to take and receive, the rents, issues and profits thereof to their own proper use and benefit, and also, that the said Burrass his heirs, executors, or administrators, will pay and discharge all taxes, impositions, assessments and other charges, whatsoever which may or shall become chargeable thereon, during his or their possession thereof.

And the said Thompson doth covenant on is part, that he will faithfully execute the trust hereby reposed in him. Thompson parties to the within deed personally appeared before me in my said office, and acknowledged the said deed to be their act and deed and the same is admitted to record. Teste. J.E. This indenture, made this twenty third day of September in the year of our Lord one thousand eight hundred and forty five between James Burrass (sic) and Franky, his wife of the county of Tazewell, and state of Virginia of the one part and George W.G. Browne of the other part.

Witnesseth: that the said James Burrass and Franky, his wife for and in consideration of the sum of forty dollars current money of the United States to them in hand paid, the receipt whereof is hereby acknowledged, do grant, bargain and sell unto the said George W.G. Browne, all their right, title and interest in a certain tract or parcel of land lying and being in the county of Tazewell on the Muddy fork of Wolf Creek, which formerly belonged to Alexander Neel, and in which as the daughter and heir of said Alexander Neel, the said Franky is entitled to one eighth part with all the appurtenances:

To have and to hold the said interest in said tract or parcel of land with all the appurtenances unto the said George W.G. Browne, and his heirs, to the sole use and behoof of him the said BrownE and his heirs. And the said James Burrass and Franky his wife for themselves and their heirs, do covenant, with the said George W.G. Browne, that they the said James Burrass and Franky his wife the said interest in said parcel of land, with all the appurtenances unto the said George W.G. Browne, and his heirs, against the claims of them the said James Burrass and Franky his wife, and every other person or persons whatsoever, shall warrant and will forever defend.

Tazewell County , to wit:We, Erastas G. Harman and William Cox, Justices of the Peace in the County aforesaid, in the state of Virginia, do hereby certify that Franky Burrass wife of James Burrass, parties to a certain deed, bearing date on the 23rd day of September 1845 and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privately and apart from her husband, and having the deed aforesaid fully explained to her, the said Franky Burress, acknowledged the same to be her act and deed and declared that she had willingly by signed, sealed and delivered the same, and that she wished not to retract it.

The decision to place her in this cemetery is from a Deed Dated July 16, 1844 Jms. & Frances put up 1/8th of the land for a loan from a Mr. Browne for the sum of $19.46, this was the land they were living on.

William H. Burress, who stands indicted for forgery was led to the bar in the custody of the jailer of this court and the jurors elected for his trail to wit: Joseph J. Mays, Samuel McGuire, Harvey Claypool, Jeremiah B. Claypool, Chapman A. Spotts, Thomas Barrett, John G. Baylor, Joseph Harrisson, Clinton Barns, Rees T. Bowen, William S. Seabolt and James Thompson appeared in court and were sworn a jury for the trail of the said William H. Burress upon the indictment aforesaid (the counsel for the accused having stricken eight of the jurors from the panel) and the jury sworn as aforesaid having fully heard the evidence were, with the consent of the prisoner, committed to the custody of the sheriff of this county who is directed to keep them together without communication with any other person and to cause them to appear here on tomorrow morning at 9 o'clock whereupon an oath was administered to E.S. Howard, sheriff of this county to the follow effect "You shall and will truly, to the best of your ability, keep this jury, and neither speak to them yourself, nor to suffer any other person to speak to them touching any matter relative to this trail until they return into court tomorrow" and the said William H. Burress is remanded to jail.

Burress, who stands indicted for forgery was again led to the bar in the custody of the jailer of this court, whereupon the jury who were sworn for his trail were brought into court by the sheriff of this county and the said jury upon their oath do say, that the said William H. Burress is not guilty of the forgery aforesaid as is alleged against him in said indictment, and nothing further appearing on being alleged against him it is considered by the court that the said William H. Burress be acquitted and discharged of the forgery aforesaid and go thereof without delay.

This day came the parties by their attorneys and thereupon came a jury to wit: John A. Brown, John Necessary, John Woods, James McBrown, John D. Peery, John B. Harman, Solomon C. Turley, John D. Rutherford, Ephraim Claypool, Robert Barrett, and William McGuire (11 by consent) who being elected tried and sworn the truth to speak upon the issue joined on their oaths returned the following verdict. "We the jury find the defendant guilty and assess the fine at $20.00." It is therefore considered by the court that the commonwealth recover against the said defendant, $20.00 the fine aforesaid and the costs of this prosecution.

Military Records, Civil War Soldiers and Saliors System, 1863.

37th Battalion Virginia Cavalry (also known as Dunn's Battalion Partisan Rangers) was organized about August 2, 1862. Company B was composed of former members of the 4th Regiment South Carolina Infantry, Company F of North Carolinians, and Company K was formerly Captain Pack's Company, 21st Regiment Virginia Cavalry. Company H was transferred to Swann's Battalion Virginia Cavalry by S.O. No. 130, Hdqrs. Dept. W.Va. and E. Tenn, dated December 28, 1864. In November it was changed to regular cavalry. It was assigned to W.E. Jones', McCausland's and W.L. Jackson's Brigade. During April, 1864, it totaled 300 effectives and by June had increased its strength to ten companies. It was involved in various operations in western Virginia and East Tennessee, then saw action in the Shenandoah Valley. The unit disbanded in mid-April, 1865. Lieutenant Colonel Ambrose C. Dunn and Major J.R. Claiborne were in command..

Witness:
Divorce record (in 1879) for William M. Pack and his wife, Rebecca Deskins. William was a brother of Sarah Pack and brother in law of William Burress.

William was divorcing Rebecca, saying basically that she was a tramp and that he had an affair with one Adam Pack.

William Burress and Tinsley Pack are witnesses for William Pack.

Adam Pack claims he had sexual intercourse with Rebecca on two different occassions and gives dates and places.

Rebecca claims, they are making the charges up and lying for William Pack to give William an excuse to divorce her and take their 4 children from her.

She claims that William Pack "gave William Burress a horse to make the statements he did in his said despostion" and that Tinsley Pack "is a brother to the complaintant and would do or swear nearly anything to promote the complaintants interest."

Testimony of William H. Burress

Asked if he is acquainted with William and Rebecca Pack, William answers "I am acquainted with them. I have known them about 10 or 12 years.

Q: Are they now husband and wife and how long have they been married
William's answer: They are now husband and wife and have been married about 10 or 12 years.

Q. Tell wheather you know of her having had carnal communication with any man other than her husband since her intermarring with the complaintant.

A. I saw a man on her one day and had her clothes up.

Q. Did you ever hear her comment with any man, other than her husband, to have carnal communication with him.

A. I have

Tinsley Pack is questioned next. He states that he has know both William and Rebecca since childhood and that they have been married for about 12 years. And that after she was ?? charges set forth in complaintants bill she had not slept a good nights sleep for fear that it would be found out on her. This she told me about three months ago.

Mary Jane Lawson testifies that she had seen Rebecca Pack and Adam Pack in bed together about 18 month ago in the state of Kentucky where the Packs were residing, and that she saw Adam Pack give Rebecca Pack a silver quarter the morning after she saw them in bed together. That when she saw them in the year of 1877 it was around Christmas time, close to midnight and it was at Rebecca Pack's house and William Pack was not home.

Asked who was at the house that night she claims it was Rebecca, Adam, Herself and 3 little children. She states that she went to bed with the children and left Rebecca and Adam drinking coffee and that it was her understanding that defendant was to get bed with ?? that Adam Pack was to occupy the other bed alone. And that when she woke up there was no fire or candle burning in the house.

She is then questioned about the weather on that night and the days leading up to that night and says most were warm, but that she could not recall all the days weather. When asked how she can recall some days and not others she states she can recall Saturday and Sunday because they had company on those days at their house which was close to William Pack's house and that on Sunday, the defendant, Adam Pack and Margaret Bishop were at her home and that "I remember distinctly that defendant got mad at Adam Pack because he talked to Margaret Bishop." She claims she remembers the time of the incident because her father died on the 5th of November 1877 and that "my best recollection is that this was about 2 weeks after his death."

Mary Jane Lawson is asked who was the first person she told and when. She said it was the 11th of August 1879 and she told Barbara Pack, and that she didn't tell before that time because she "thought it wasn't necessary to tell it" and that why did she think it was necessary to tell it now, to which she replied "Because I thought they were done parted and it couldn't do any harm for one to tell it."

She is then asked about her relationship with the Defendant and claims they are good friends and have always been such. That she used to sometimes stay the night over at Rebecca Pack's house, but she had not stayed there since the incident and that she had never said anything to the defendant about the affair because "I always hated to name it to her."

When asked how she saw the defendant and Adam Pack together in bed, if there was no fire in the home, she stated that the house was a log home and the moon shined through the logs so she could see. She is then asked what time the moon rose that night and if there were any hills or mountains or trees around and what direction they were in, and in what position the moon was in (I guess trying to establish how much light there was and if it was obstructed in any way) She claims there were some hills and that the moon was striaght over head. She is questioned that, if the moon was overhead, "how could she shine her rays through the cracks of a log house?"

She answers "the moon shines all around and of course light came into the house."

A different Mary Lawson is questioned and states that she knows for a fact that Rebecca and Adam Pack were together in the year of 1877 when William Pack was absent. And that Rebecca Pack had told her that Adam Pack had given her money and other things at different times. And that Rebecca told her that Adam had given her several things and would have given her more but that he was afraid of her husband.

She also states that she has seen Rebecca Pack and Adam Pack standing and talking to each other when no one else was around and it was through the summer of 1877.

She was asked if she had not frequently seen a man and a woman talking alone together before and she replied that she had, but "this couple had been staying together for several days and nights and this made me think strange of it."

Mary is asked if Adam Pack is a brother of the Complaintant and if the complaintant got Adam to stay with his wife when he was absent. She answers that Adam Pack is not his brother but a first cousin and that she does not know if the complaintant got Adam to stay with his wife while he was away.

When asked where William Pack was during this time, Mary states that he was in Virginia to see relatives and she didn't know that he had any special business while there.

Barbara Pack is questioned next. When asked if the defendant admitted to her that she was guilty of the charges brought against her, Barbara claims that she did admit to them and said she was guilty of all of them and believed Adam Pack loved her and had not slept a good nights sleep for fear her husband would find her out. When asked she states that William and Rebecca have not resided together since the charges were brought and that William Pack has been staying with his brother Tinsley Pack since then. Barbara Pack claims she is a neice of William Pack. That William Pack had told her that he had mistrusted his wife, but was not certain of her guilt until now.

Tinsley Pack is sworn in as a witness: Asked how it happened that that defendant made confessions to him of her guilt. "On one Sunday evening while my wife and niece had left home to attend meeting, defendant confessed to me that Adam Pack had told her that he loved her and that she had committed adultery with him and that since she was guilty with him she had not slept a good nights sleep for fear her husband would find it out through Adam Pack.

George W. Blankenship is questioned about Adam Pack's charater. He states his wife (not named) is a 1st cousin of Adam and that he knows his character for truthfulness is bad, that he doesn't think he has ever had a permanent home anywhere since he had come of age. "I think he has been a rambling person ever since he was 12 years of age."

William Bottimore gives testimory to the court regarding William Burress' character: "He lived very near me for I suppose some 20 years and I think I ought to know his general character for truth and veracity." He goes on to say that his character "was not good for truth and veracity."

The court then asks Mr. Bottimore if he thought William Burress' character for truth would be any better under oath. Mr. Bottimore replies, "That would depend upon the interst he had in the case - if he had any interest the case, it would not."

Mr. Bottimore also states he knows Rebecca Pack's, the defendants character to be good.

William Bottimore than goes on to explain that, "about the time they (William & Rebecca Pack) left the place where they had lived near my house, Tinsley Pack, brother of the complaintant in this suit, in a conversation with me about William H. Burress, in which he (Pack) spoke in a very disparaging manner of him (Burress) told me that Burress has tried to induce complaintant (William Pack) to believing that his wife, Rebecca E. Pack had had an improper intimacy with him (Tinsley Pack).

William Bottimore adds that he knows W.H. Burress' character for truthfulness is bad based on common report and personal knowledge.

Asked if Tinsley Pack denied the charge from Burress that he had had improper intimacy with William Pack's wife Rebecca, Bottimore states that Tinsley told that the charge was ridiculous.

Next to give statement is William Barrett (Rebecca Packs brother in law), who claims he has never heard Rebecca Pack's character of virtue to be bad. He also states he knows nothing of William H. Burress' character.

Mr. Barrett is than asked that "whether two months ago at Joseph Peery's Mill in this county, you had a conversation with William H. Burress relative to this case and if so, please state what he said."

He answers: "I did hae such a conversation with William H. Burress. He told me at this time that William M. Pack had told him that he intended to have him summoned to testify as a witness in this case and that he (Burress) had told him (Pack) that he need not do it, that he could not not swear in his favor but that he would have to swear in favor of his wife, Rebecca E. Pack, and that he had never known anything wrong of her in his life.

The next witness is W.G. Bottimore and he is asked if he is acquainted with William H. Burress and his character. His answer, "I am only slightly acquainted with William H. Burress - I have never had any business relations with him. I have however heard a number of persons say that they regarded him as a bad man and as an untruthful one."

Asked, based on what he had heard, did he believe William Burress to be a man of good or bad character for true and veracity, to which he replies, "My only inference was that he was a man of bad character for veracity." He also states he would have severe doubt in believing him under oath.

He is asked how far he lives from William H. Burress, and he claims 7 miles.

W.G Bottimore also claims he knows Rebecca to be a modest woman who took good care of her children and her home.

George W. Deskins (who lives 4 miles from William Burress) is next to be interviewed. Asked if he is acquainted with William H. Burress and his character, he replies, "I suppose I am. His general character, as far as I know, is not good."

Asked if William Burress could be belived under oath, George stated: "I don't think that a man could have much confidence with a man who was generally known to steal and lie."

George Deskins also claims that he has known Rebecca since she was a child and that he was always known her to be a good woman, and that he is her 3rd cousin.

James W. Smith is the next witness. When asked about William Burress and his character for truth and veracity, James states, "Bad" Asked if he would believe William Burress under oath, James replies, "I would not."

James is asked how far he lives from William Burress and where William lives: 3 miles from William and William lives on the Lower ? of Baptist Valley on the land of David J. Gillespie on the Clinch River.

Asked why he would not believe William under oath he claims: "Because I have heard so many people express unfavorable opinions before to his character.

James also vouches for the good character of Rebecca Pack.

J.M. McCall is the next witness, but he says he is not acquainted with William H. Burress and considers Rebecca Pack a virtuous woman.

George W. Gillespie (Witness), when asked about William Burress and his character, simply states BAD. When asked if he would believe William Burress under oath, George says, "I would not in a case in which he was interested." Asked how he knows William Burress' character is bad, he says, "By having business transactions with him and by hearing others speak of him."
George Gillespie lives 5 miles from William Burress.

Next there are witnesses brought in to testify to the character of Adam Pack. All of which say his character is bad. One states of Adam Pack "I have known him ever since he was a small boy - He is now about 36 or 37 years of age. His character ever since I have known him has been very bad - He has for the last several years been wandering around over the county aimlessly without any fixed place of abode so far as I know - he could not be said to be a citzen of any community."

Another witness claims that Adam Pack is a first cousin to the complaintant (William Pack)

Witnesses also claim that Adam Pack hasn't lived in the county for some 6 or 7 years, that he resides in Kentucky and will occasionally wander back to Tazewell as he has no permanent home. And that when he does come back to Tazewell, he never stays more than 8 or 10 days at a time.

Your complainants, Sarah E. Brooks, Mary E. Brooks and Hattie V. Brooks, would respectfully represent that their father, Jerome B. Yost, died in the year 1885, intestate, leaving to survive him as his heirs at law a widow, Rachael, L. Yost, and four children, to-wit, (1) your complainant, Sarah E. Brooks (nee Yost); (2) your complainant, Mary F. Brooks (nee Yost); (3) Robert L. Yost; and (4) your complainant, Hattie V. Brooks (nee Yost); that Sarah E. Brooks is now thirty (30) years of age; that Mary F. Brooks is now twenty-eight (28) years of age; that Robert L. Yost is now twenty-six (26) years of age; and that Hattie V. Brooks is now twenty-two (22) years of age, the youngest, Hattie V. Brooks, being only six months old when her father died; that Sarah E. intermarried with M.C. Brooks; that Mary F. intermarried with Joseph Brooks; that Hattie V. intermarried with James P. Brooks; and the said Rachael L. Yost, the mother of complainants, and the widow of Jerome B. Yost, deceased, after the death of the said Jerome B. Yost, intermarried with John R. Radford.

Your complainants further represent that just prior to the death of the said Jerome B. Yost he was negotiating with one Edward P. Moore for the purchase of one hundred (100 A) acres of land situated in Tazewell County, Virginia, on Little Stony Ridge and Big Stony Ridge, but that before the money was paid and the deed executed for said land the said Jerome B. Yost died, and after the death of the said Jerome B. Yost his widow, with her children, moved into the home of George Burress, who was the father of Rachael L., the widow of the said Jerome B. Yost, and the grandfather of complainants. Just after the death of the said Jerome B. Yost and after the said Rachel L., widow of Jerome B. Yost, with her children, had moved into the home of the said George Burress, the said Edward P. Moore came to the home of the said George Burress for the purpose of completing the sale for the said one hundred (100 A.) acres of land and executing a deed and receiving the purchase money for the same, and the said George Burress, acting for the said widow and children of the said Jerome B. Yost, deceased, purchased the said one hundred (100 A) acres of land from the said Edward P. Moore and paid for the same out of the money and property which Jerome B. Yost owned at the time he died, the said one hundred acres (100 A) of land being purchased for the sum of Three Hundred and fifty ($350.00) dollars.

Your complainants would further represent that although the said tract of land was purchased from the said Edward P. Moore by the said George Burress for the heirs at law of the said Jerome B. Yost, deceased, and with the funds furnished by the estate of the said Jerome B. Yost, the said George Burress had the land conveyed by the said Edward P. Moore and wife to himself, when it should have been conveyed to the heirs at law of the said Jerome B. Yost. The said deed from the said Edward P. Moore and wife to the said George Burress is dated the 21st. day of May, 1888 and is now of record in the office of the Clerk of Tazewell County, Virginia, in Deed Book 24, Page 228, a certified copy of which is herewith filed as a part of this bill, marked ?Exhibit A?.

Your complainants would further represent that the said George Burress, together with the widow and children of the said Jerome b. Yost, moved upon said one hundred (100 A) acres of land and began to cultivate the same and to get their maintenance and support from said land. The widow and all of the children of the said Jerome B. Yost worked upon said land and assisted in farming the same and raising the crops, from which they realized their support. At the time the said land was conveyed by the said Edward P. Moore and wife to the said George Burress, the said George Burress was in very poor circumstances, having no land and very little, if any, personal property, but after the date of the said deed they all lived and worked together until the daughters of the said Jerome B. Yost married and left the said land. During the whole of the time that the said widow and heirs of the said Jerome B. Yost lived upon the said land with the said George Burress, the widow and all the girls, with the others, assisted in all of the work on the said land, the girls working in the fields with the said George Burress.

Your complainants would further represent that at the time the said deed was made by the said Edward P. Moore and wife to the said George Burress they were small children, the oldest one being eight years of age, and that after the said deed was made their mother requested the said George Burress to execute a deed, conveying the said land to the heirs of the said Jerome B. Yost, deceased, and the said George Burress stated to their mother that he would hold the whole of said land for the said children of the said Jerome B. Yost, deceased, to which their mother consented, and during the whole time since the conveyance by the said Edward P. Moore and wife to the said George Burress he has lived upon the said land with all or part of the heirs at law of the said Jerome B. Yost, with the understanding that he was holding the said land for the said heirs at law of the said Jerome B. Yost.

Your complainants would further represent that the said George Burress is now over seventy years of age and has become dissatisfied and states that he is going to sell said land and dispose of the proceeds of the sale as he wishes, but that none of complainants are to have any part of the proceeds of the sale of the said land.
Your complainants would further represent that until the last few months their brother, Robert L. Yost, was friendly with them and acknowledged that the said one hundred (100 A) acres of land was held by the said George Burress for the heirs at law of the said Jerome B. Yost, deceased, and that the said heirs at law were the real owners of said land, but recently he has become estranged from complainants and complainants believe and aver that the said Robert L. Yost has persuaded the said George Burress to convert the said land into money, believing when this is done that he will get from said George Burress the proceeds derived from the sale of said land.
Your complainants are advised and believe that the heirs at law of the said Jerome B. Yost are the owners of said one hundred (100 A) acres of land and are entitled to have a conveyance from the said George Burress to them of the same, and that complainants are entitled to have their part of said land conveyed to each of them.
Your complainants further represent that they are advised and believe that they are entitled to recover from the said George Burress a reasonable amount for the rents, issues and profits of the said land, which he has converted to his own use.

At the time of the conveyance from Edward P. Moore and wife to the said George Burress, the said George Burress was married, his wife being ______ Burress, who is still living.

Being without remedy at law, your complainants come into a court of equity and pray that George Burress and _________ Burress, his wife, Rachael L. Radford and Robert L. Yost be made parties defendant to this bill, and be required to answer the same, but not on oath, oath being waived under the statute; that the said George Burress and _______ Burress, his wife, be required to convey to complainants the interest of complainants in the said one hundred (100 A) acres of land and that they recover from the said George Burress a reasonable amount for the rents, issues and profits derived from the use of said land, which the said George Burress has converted to his own use.

And the complainants pray for all such other, further and general relief as the nature of their case may require, or to equity shall seem meet. And they will ever pray, etc.

The separate answer of Robert L. Yost to a bill in chancery exhibited against him in Court by Sarah E. Brooks and others, respectfully states that it is charged in said bill that until the last few months your respondent was friendly with the complainants and acknowledged that the One Hundred acres of land was held by his grandfather and co-defendant, George Burress, for the heirs at law of Jerome B. Yost, deceased, and that said heirs at law were real owners of said land, but that your respondent has recently become estranged from complainants and that complainants believe that your respondent has persuaded said George Burress to convert said land into money so as your respondent would finally get the proceeds thereof. This allegation must rest wholly in the imagination of the complainants, for there is not the slightest truth in it and your respondent denies it. Your respondent, since he has left the home of his grandfather, which was when he was about eighteen years old, has been working for himself and attending to his own business, and he is free to say that he believes the attempt to take said land from his grandfather by the complainants is one of ingratitude and very unjust and unfounded. It is true that your respondent was very young when his father died, and when his grandfather purchased said land and his father being very poor and diseased for several years before his death, your respondents mother and his sisters were taken to the home of their grandfather, some two or three years before he went upon the one hundred acres of land, and that respondents mother remained a short while with her father, then left all of the children, except Hattie, who she took away and carried from place to place for a while and then returned her to her grandfather, and his mother took away with her all of the household articles which belonged to his father.

Your respondents grandfather took good care of him and his sisters, clothed and fed them well, maintained them above want, and let them have education at the free schools in the neighborhood, by which, at least, your respondent has been able to go out into the world since he was eighteen years old and make a good living.
Your respondent knows the fact that his father left little or no personal property at his death, and respondent does not believe that he ever bought the land or negotiated to buy it from E.P. Moore, but he believes that his grandfather bought and paid for it.
Of this your respondent is certain, that this grandfather moved upon this tract of land while it was all in woods, built his dwelling-house and cut houses upon it, and cleared up one half of it with his own hands.
Wherefore your respondent prays hence to be dismissed, with his costs, etc.

To the Hon. W. J. Henson, Judge of the Circuit Court of Tazewell County, Virginia

Sarah E. Brooks and others, having exhibited a bill in chancery in this court against George W. Burress and others, the said George W. Burress comes and says that the matters and things alleged in said bill are not sufficient in law or equity to maintain the same; wherefore, the said George W. Burress demurs to said bill and prays judgment of the court thereon. For special causes of demurrer the said George W. Burress says:

1. The bill is with equity to sustain it

2. It seeks to obtain the relief prayed for by attempting to show a constructive trust, but the allegations thereof are insufficient, both in law and equity, to establish such trust

3. The lapse of time and change of circumstances, as well as the change of the character of the land as disclosed by the bill, are sufficient to deprive the complainants of relief in a court of equity.

If the foregoing demurrer should be overruled and the said defendant, George W. Burress, be required to answer said bill then he answers and says: That he is the owner in fee-simple of the one hundred acres of land in the bill mentioned, and conveyed to him by Edward P. Moore and wife by the deed dated the 21st day of May, 1888, a copy of which is filed as part of said bill (exhibit A) that he purchased this land himself and for himself, directly from the said Edward P. Moore and paid therefor the said sum of $350.oo the consideration mentioned in the deed.

Your respondent further represents and avers that the allegations of said bill, that Jerome B. Yost in his lifetime negotiated with the said Edward P. Moore for the purchase of said land, or that after the death of the said Jerome B. Yost, your respondent acting for the widow and children of the said Jerome B. Yost, purchased the said one hundred acres of land for the said wife and children of the said Jerome B. Yost, and paid for the same out of the money and property which the said Jerome B. Yost owned at the time of his death, are wholly unfounded and untrue, and your respondent further avers that each and all of the allegations of said bill, which are contrary to the statements hereinabove made by your respondent, namely, that he himself and for himself purchased said land from the said Moore and paid for same, are equally unfounded and untrue.

It is stated in said bill that the said Jerome B. Yost died in the year 1885, intestate, and that just prior to his death he was negotiation with Moore for said land; when the truth is that said Moore died not at that time own said land, and really acquired it by purchase at a judicial sale on the 20th of October, 1886, from J.W. Chapman, Commissioner, acting under decrees of a chancery cause then pending in the Circuit Court of Tazewell County, Virginia, which said sale was confirmed by decree on the 17th day of November, 1886, and the land conveyed by said Commissioner, Chapman, to the said Edward P. Moore, on the 23rd day of April 1888, by deed of that date, a copy of which said deed is filed as part of the answer, marked ?Moore.?

Your respondent further avers and represents that E.P. Moore, being the owner of a debt for which this land was sold at the judicial sale, wanted your respondent to purchase same at said judicial sale (Moore really paying $175.85 for said land) but your respondent would not do so, but in a very few days after Moore got a conveyance for said land he agreed to purchase the same from Moore, and on the 21st day of May, 1888, less than a month after Moore obtained his deed from the Commissioner, your respondent obtained his conveyance from Moore.

It is true, as stated in the bill, that your respondent is now over Seventy years of age and when he was much younger, by about twenty years, when he went upon this tract of land which was in an isolated place and all a heavy forest of timber, and your respondent at once after his purchase, took possession of this land, erected a little cabin on it, went to work clearing it up and has now cleared on it about fifty acres, and has erected thereon a better dwelling house of four rooms, a good frame barn, twenty feet square, well shedded around, corn cribs, meat house, good spring house, and planted out a good orchard, which has had time to grow up, and is now well bearing fruit ? so improving his said land, almost by his own individual labor, as to now make it worth not less than $2000.00 The said Jerome B. Yost was a son-in-law of your respondent and for many years before his death was in feeble health, afflicted with consumption and incurable, and for a few years before his death was unable to support himself and family, and having neither land and but little or no personal property, your respondent supported him and his family until he died; and after his death, paid some of his remaining debts, and his wife and children, three of whom are now complaints in this suit, came to your respondent?s house, when they were very small, complainants Sarah and Hattie remained with your respondent until they were married and Mary remained there 8 or 10 years, and the defendant, Robert L. Yost, stayed with your respondent until he was 17 or 18 years old. During that time your respondent had them to attend the free schools and clothed and fed them, and now he is being repaid, as in many times the case, with their ingratitude by attempting to drive out your respondent in his old age and render him homeless and helpless. His daughter, the wife of Jerome B. Yost, remained with your respondent until she unfortunately, behaved badly, and left your respondent?s home and married again, and never returned, abandoning at once all her children except the youngest, which she carried from place to place for a while, and finally returned her to your respondent. When she left, she took with her all the household articles which were left by her husband at his death. All this occurred before respondent moved on the said one hundred acres of land.

Your respondent further represents and avers, that Jerome B. Yost left no property at his death out of which to pay for said land. True, your respondent was what might be called a poor man when he purchased the land from Moore, but he had ample means to pay for same, which he did promptly. It is not true that the widow of Jerome B. Yost and the children worked the land. The widow was not there and the children were of tender years, and if any work they did, it was light and of no consequence. The allegations of the bill that your respondent stated to the widow of Jerome B. Yost that he would hold the whole of said land for the children of Jerome B. Yost, is wholly false and unfounded. It is also untrue that his co-defendant, Robert L. Yost, has persuaded your respondent to convert said land into money, with a view to himself finally getting it. This charge is reckless and unfounded. As evidence of the fact that our respondent has been always dealing with said land as his own and as he pleased and had a right to do several years ago, ten or more, he sold off a boundary thereof, probably eighteen or twenty acres, for two hundred ($200.00) and conveyed same which is now the property of one Charles Bowman.

Your respondent denies any and all allegations of the bill, inconsistent with the statements of this answer. Your respondent has denied the allegations of the bill and has shown that they cannot be true, but is advised by his counsel, as a question of law, that if the allegations of the bill were true (and they are not) that the lapse of time since your respondent purchased said land and took possession thereof, and the changes which have taken place, as shown on the face of said bill, and the want of legal or equitable facts set forth in said bill, and the insufficiency generally of said bill, should cause the court to dismiss same without annoying and harassing your respondent with making further defenses in this cause, not to mention the fact of the changes which your respondent has made by his labor and expenditures upon said land, and the great expense, trouble and care imposed upon him in rearing and maintaining the plaintiffs. And having fully answered, prays hence to be dismissed with his costs, etc.

His granddaughter Hattie Yost Brooks was living in McDowell County at the time with her family. That is probably where he was. In 1928, when Sarah died, she was also at Hattie's residence. Looks like she took care of the grandparents in their old age.

Pending the arrival of his daughter from Utica, N.Y., funeral service arrangements for Benjamin Rush Burress, 79, who died suddenly at 12:10 yesterday morning at his home at St.Clair's Crossing, had not been completed last night. It was announced by relatives that the services would probably be held Saturday and burial would follow at Maple Hill cemetery in West Graham.

Mr. Burress, a widely known Tazewell County farmer, had suffered from a heart ailment for a number of years but his condition was never regarded as serious. He suffered a hemorrhage soon after midnight and died within a few minutes.

Mr. Burress was a native of Burkes Garden and had spent his entire life in Tazewell County where he had engaged in farming. He was born September 31 [sic], 1857, being a son of the late Jimmie and Frances Neal Burress.

Sixty years ago he married Emma Cox, of Tazewell County, and they moved to St. Clair's Crossing 41 years ago from Clearfork.

He is survived by his wife and the following children: Mrs. J.R. Witten, of Bluefield, Mrs. D.C. Weaver, of Utica, N.Y., Mrs. R.M. Milfeet, of Washington, D.C., Conner Burress, Roy Burress, Lake Burress, all of St. Clair's Crossing, and Claude Burress of Washington. He also leaves ten grandchildren and one great grandchild.

Funeral services for Ben. R. Burress, well known Tazewell County farmers, will be held at his home at St. Clair's Crossing this afternoon at 1:30 PM. The Rev. M.S. Cooks will officiate.

Interment will be made in Maple Hill Cemetery, West Graham. Active pallbearers will be: S.L Smith, W.M. Patrick, C.K. Wimmer, W.L McFarland, Luther Stevenson and Alex St. Clair. Flower bearers will be grand daughters of the deceased. Mr. Burress is survived by his wife and seven children.

JOHN BURRESS, RICHLANDS, DIES

Native of Tazewell County Had Been Bedfast from Rheumatism For Past Six Months; Funeral Today Richlands, VA, May 24 --

John Burress, 68 died at his home one mile northeast of Richlands early this morning from rheumatism, from which he had been bedfast for the past six months.

He was a native of Tazewell County and was twice married.

His first wife was a Miss Tilda Earls of near Gillespie.

His second wife was a Miss Cinthia Chambers of near Richlands.

He was known quite well among the people of Tazewell County as the "horse trader" on account of his good judgement of horses.

He is survived by his wife and the following children: John Burress, Jr.; Raleigh Burress of West Virginia; Newton Burress of North Tazewell; Mrs. George Quesenberry of Pounding Mill; Mrs. Henry Shortridge and Mrs. Vergil Reedy of Richlands.

Funeral will be held at the home Saturday and interment will be in the Jones Chapel cemetery near Cedar Bluff

George W. Burress, 65 years of age, died Monday at the home of his daughter, Mrs. Wade Jennings at Adria. He had been in declining health for several years. He was the son of the late William and Sarah Pack Burress, of Pounding Mill. He had been a resident of North Tazewell for about fifty years. He is survived by his wife, the former Miss Daisy Arnold, two daughters and three sons: Mrs. Jennings, Mrs. James Whitman, of North Tazewell; Paul and Lloyd, of Norfolk, and Vernon, of Whiteville, W. Va. A sister also survives, Mrs. Laura Vann, fo Huntington WV. Funeral services were held from the Christian church Tuesday afternoon with the Rev. C.B. Dickenson, of Crumpler, WV., and the Rev. M. E. N. Lindsay in charge.

In 1939 they had anywhere from 20 to 30 people, from all ages. They had to be totally unable of taking care of themselves and not having anyone in the family that could take care of them. We had no entertainment. Sometimes some of the churches would come out and hold services.

I, John R. Pack of Tazewell County, Virginia, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my last will and testament, hereby revoking all wills by me at any time heretofore made.First, I do give and bequeath all my money and a One Thousand Dollar Government Bond equally to my four children, namely: Brooks F. Pack, Ellie Whitaker, Thelma Christian, and Helen McCann.Second, I do give and bequeath all other personal property found upon my farm at my decease equally to my four children above named. It is my desire that they divide the property in kind if they can come upon an agreement as to how it should be divided, and if they cannot do this, it is to be sold by my executor and the proceeds divided equally.Third, I do give, devise and bequeath my two daughters, Ellie Whitaker and Thelma Christian, the lower part of my farm joining Bill Whitaker and starting below the house at a locust post on the edge of the public highway; thence from this post a straight line to the main branch and from there running with the fence as far as it goes, then dividing the spur a straight line to where my land joins the Gillespie heirs. Fulton Kegley, Judge of the Circuit Court of the said County: Humbly complaining your Oratrix, Orgie Burress, would respectfully represent that on the ---- day of-------19l4, she bought from the Graham Land & Improvement Company, in Graham, through Walter Graham, its President, a lot of land in what is commonly called South Graham, on the opposite side of the road that passes by the residence of her father, J. W. Burress.

This road is the main thoroughfare leads from the said Town of Graham to and intersects with the main Cumberland Turnpike road near the residence of Mrs. Vicie A. Burress, and which has been recently macadamized out of the bond issue road money of Tazewell county; and is a road that has a great deal of travel over it.

For the lot in question your Oratrix was to pay the Graham Land & Improvement Company the sum of Two Hundred and Fifty Dollars; but, if she paid all cash she was to have a discount of Eighteen Dollars.

Shortly thereafter she sent the said Walter Graham a check on the Bank of Graham for this Two Hundred and Fifty Dollars, expecting him to return to her the said Eighteen Dollars when the said check was cashed.

The said Walter Graham obtained the cash the said check in a very short time thereafter; but to date he has never returned to her the said Eighteen Dollars.

Your Oratrix took possession, under this purchase, of the said lot, and had the same enclosed by a wire fence and she promptly applied to the said Graham Land & Improvement Company, and the said Walter Graham, it's President, for a deed to the said lot.

And although she has made repeated demands on them for her deed, she has thus far failed to get any satisfaction. At the time she made the contract in question, it was agreed between your Oratrix and the said Walter Graham that the said lot was to be 60 feet in width, and was to face and front on the before named street from the North, and was to run back between parallel lines, at right angles to the said street, that width, to the line of J. W. Hicks, near the top of a hill that lies just North of the said street, and on the side of which hill the said lot is located, thus making the said lot about 305 feet in length.

This lot lies just west of and adjacent to the West line of Mr. Frank Cook; but is longer than his said line.

Your Oratrix was very particular with Mr. Walter Graham to have a distinct understanding with him that the lot in question was to run straight up this hill.

When your Oratrix applied to him for a deed, he informed her that he was having the said hillside laid off into lots; and that as soon as he got this done, he would make her a deed.

He did have this land laid off into lots: but he did not run them straight up the hill, as was agreed; but he ran them so as to run up this hill in a very slanting manner, and in such shape that no man in his right mind would have them.

He then made and tendered to your Oratrix a deed to one of these lots; but it did not convey the land she had bought, and she refused to accept it.

At this juncture he admitted that there had been a mistake made in making this survey and map; and he said he would have a correct survey made, and make a correct map of it, and make a correct deed.

Whether he ever made this map or not your Oratrix does not know; but he did make a small map of the said Frank Cook lot; and he laid off a lot West of and adjacent to this lot, making it 56.25 feet wide on the front, and 56.25 feet on the rear, and only 120.7 feet in length; and he thereby did not run it back to the aforesaid Hicks line.

He then made another deed to this lot thus laid out; and tendered it to your Oratrix; but as it did not comply with her contract with him, she refused likewise to accept this new deed.

Since that time she has not been able to get him to do anything, one way or the other; and he refuses to make her a correct deed.

The lot in question should front the street mentioned, bordering on the North side thereof, of the width of 60 feet, and should run straight up the hill that width, between parallel lines, N. 17 45 E. 305 feet to the Hicks line, the Easterly line thereof bordering on the westerly line of the said Frank Cook lot.

Being without remedy, save in a Court of Equity, your Oratrix comes into this court and prays that the Graham Land & Improvement Company be made a party defendant to this Bill, and required to answer the same, but not on oath, that being waived; that a proper survey be made of the lot in question, according to the terms of the purchase herein set forth; that a commissioner be appointed by this court to convey the same to your Oratrix; and that this be done at the costs of the defendant Graham Land & Improvement Company.

And she prays for all such other, further and general relief as to a Court of Equity may seem proper; And as in duty bound she will ever pray, & c. Orgie Burress, By Counsel.J. W. Hicks, Counsel for Complainant.

Orgie Burress vs. Graham Land & Improvement Company. Enter this decree this May 27th, 1915.

This cause came on again to be heard upon this 27th day of May 1915, upon the bill and exhibits therewith filed, and on the demurrer heretofore filed therein, and the joinder therein by the complainant.

Thereupon the complainant moved the court to allow her to amend the said bill, which said amendment was allowed by the court, and was made by inserting in the said bill the following amendment: "and since this bill was filed your oratrix has broken up the ground of the entire lot, planted the same, and now has a growing crop upon the entire lot.

And thereupon the defendant renewed its demurrer to the said bill as amended, and the court having heard the argument on the said demurrer, it is adjudge, ordered and decreed that the said demurrer be and it is hereby sustained, and that said bill be and it is hereby dismissed, and that the defendant recover of the plaintiff its costs in this suit. Grace Hall was chosen master of hounds and the dogs were not long in finding a good trail. The chase lasted an hour when the fox went to earth near the big bluffs under the brink of the mountain. E.T. Brown, Charles Townsley, James Belcher, John Upton, Jess Cabell, Will Rose, Robert Crocker, Tom Smith and W.E. Cook of the B.R.T at Hinton, accompanied the remains of B.G. Burress from Hinton to Graham and attended the funeral at the latter place yesterday.

The funeral of B.G. Burress took place at Graham in the presence of a large number of friends and relatives. The services were conducted by Rev. Mr. Davis and Mr. Steele. the following members of the Hinton Brotherhood of Train: L.F Cabell, C.L. Townsiev, I.P. Upton, B.F. Corker, W. Rose, O.P. White, R. Sensley and I.D. Wade, and a large delagation ofrom the Bluefield lodge attended. The Hinton lodge contributed a hansome floral brakewheel.

Mr. Burress was aged 28 years, two months and seven days. He joined the Christian church in 1896 and has been a consistent member since. He loved railroading and thought he could do nothing else. He possessed a forgiving spirit and it did not matter what kind of treatment he received he could forgive and forget. He also possessed a spirit of giving and gave literally to all who were needy.

Victim of Scarlet Fever

Death of Mrs. Hattie Burress Jennings Occurred Yesterday Morning.

Mrs. Hattie Burress Jennings died yesterday morning after a short illness of scarlet fever. She was married on the 4th of last December at Ironton, Ohio, to A.E. Jennings, bookkeeper for the Flat Top Grocery Company and the young couple were quite popular. She was the daughter of Mr. and Mrs. J. Wesley Burress, of Graham, and made her home in that town until her marriage, when she came to this city and the young couple took up their residence at 407 Scott Street. The deceased was a member of the Methodist church. She will be buried in the West Graham Cemetery at 2:30 this afternoon, the funeral taking place from her late home at 1 o'clock with religious services at the grave. Mrs. Burress is the first of those who have become ill with scarlet fever to die during the recent scare. How she contacted the disease is unknown.

Mr. and Mrs. J.W. Burress received a message yesterday morning announcing the marriage of their daughter, Miss Jessie Burress at Roanoke, to Charles Elam. The bride left here Thursday morning and was joined at Roanoke by Mr. Elam and they were married soon afterwards and went on a wedding trip to Richmond and other points. Mr. Elam resided at Graham about two years ago, but is now holding a responsible position with a shoe factory in Lynchburg. Upon their return from their wedding trip the happy couple will reside at Lynchburg.

• Newspaper: 11 May 1915, Graham, Tazewell, Virginia, USA; Nearly Two Yenrs Since He Was charged With Attempting Assult The arrest Sunday of Connor Burress by Pocahontas officers caused considerable talk and comment in Graham yesterday. The charge upon which he was arrested was an alleged assault upon Mrs. Dale Martin nearly two years ago. Soon after the time of the alleged assault the accused left this section and was supposed to be somewhere in Illinois. It seems that for some months he has been coming to the home of his parents near St. Clair and would remain for a short time, but the reports indicate that his coming and going were kept a secret. It had been so long since the assault was supposed to have been made that tho local officers thought the matter had been disposed of. Some weeks ago it appears that a Pocahontas officer asked a Graham official if there was a warrant for Burress, but the Graham officer had no knowledge of such a paper being in existence. It now appears that the matter was taken before the grand jury at a term of court soon after the trouble came up and an indicment was returned against Burress. Saturday the Pocahontas officials phoned to Sergeant Havens that they had Burress and when it was found that there was a indictment against him Officer D. N Matthews went to Pocahontas Sunday and brought the prisoner to Graham and placed him in jail until yesterday afternoon when he was taken to Tazewell and lodged in jail to await trial at the next term of court. From all reports it seems that the defendant was intoxicated at the time he is charged with having attempted to commit the crime. Falling from a freight car at North Tazewell yesterday morning, Lake Burress, 48, Norfolk and Western railroad brakeman, of Bluefleld, was painfully injured. Burress was riding a draft of cars when a sudden application of the air brakes caused him to lose his balance. He fell to a parallel track, landing across one rail. It was first thought that he had suffered a pelvic fracture but X-ray examination at Bluefleld sanitarium failed to show any broken bones.

Lake Burress, Virginia Side, Dies Lake Burress, 66, of Bluefield, Va. died at Bluefield sanitarium last night at 10:15, following an illness of two days. He was employed by the Norfolk and Western Railway company for the last 36 years, as a conductor. Mr. Burress was a member of the Masonic lodge and the Brotherhood of Railroad Trainmen. Mr. Burress is survived by his wife, the former Miss Myrtle Thompson, of Bluefield, Va., and the following daughters, Mrs. Edith Patrick Mrs. Dewey Evans, and Mrs. Richard Yost, all of the Virginia Side. His mother, Mrs. Emma Burress, of Bluefield, Va.. also survives. His father, Ben Burress preceded him in death. Funeral arrangements are incomplete.

1 January 1947 - Funeral services will be held Thursday afternoon at 2:30 at the West Graham Methodist church for Lake Burress, 55, of ClearFork, Va who died at Bluefield sanitarium Monday night at 10:15, following an illness of two days. The body will be removed to the church at 1 o'clock where it will lie in state until the hour of the service. The Rev. D. T. Wright, assisted by the Rev. H. A. Phillips, will be in charge of the services. Interment will follow in Maple Hill cemetery. Harman Lodge AF & AM 222 will have charge of the services at the grave.

Roy Mason Burress, 80, of Greasey Ridge near Princeton, died Monday morning in a Beckley hospital following a long illness. Born at Clearfork, Va., he was a son of the late Ben and Emma Cox Burress. He was a veteran of World War I, serving in the U. S. Army. He was a retired Norfolk & Western Railway engineer with more than 46 years of service. He was a member of the Veterans of Foreign Wars, American Legion Post 54 of Princeton and the Princeton Old Guard Chapter. Surviving are his widow, Mrs. Agnes Hendricks Burress; and one sister, Mrs. D. E. (Dottle) Weaver of Washington, D. C. Funeral services will be held at 2 p.m. Thursday in the Burns Wornal Chapel of Memorial Funeral Directory in Princeton with Rev. Roby Belcher officiating. Burial will follow in Woodlawn Memorial Park Cemetery at Bluewell. Witnesseth: That for one dollar cash in hand paid by the parties of the second part to the parties of the first part, the receipt of which is hereby acknowledges, and other consideration as hereinafter set forth, the said parties of the first part do hereby grand, sell and convey, with covenants of general warranty of title, unto the said Byrd P. Payne and wife to Kathleen Payne, of record in the Office of the Clerk of Circuit Court of Tazewell County, Virginia, reference to which is here made for a more complete description of the property hereby conveyed; and being the same real estate which was conveyed to the grantors herein by J. Ed Bandy and Blanche Bandy, his wife, by deed dated the 24th day of July, 1939 and recorded in the aforesaid Clerk's Office in Deed Book 145 page 306 reference to which is also made for a more complete description of the property hereby conveyed.

Reserving, however, unto the grantors, and to the survivor of said grantors, so long as either of said grantors may live, a life estate in said lots or parcels of land hereby conveyed.

It is expressly understood between the parties hereto that there is a Vendors Lien subsisting against this property to secure certain deferred installments of the purchase price owing to J.A. Payne as set forth and mentioned in the aforesaid deed from J. Ed Bandy and wife. Of the notes therein mentioned, the last two in the principal sum of $22.22 and $22.23, respectively, are unpaid and outstanding.

The parties of the second part, by their acceptance of this deed, do hereby assume the payment of the said unpaid deferred purchase money, as evidence by the notes aforesaid, witness the following signatures and seals.

Thereupon came Emma Mabe, one of the subscribing witnesses to said writing, who, after being duly sworn, stated that the said writing was signed by placing her mark thereon, and acknowledge by the said Sarah M. Shortridge as and for her last will and testament in her presence, and in the presence of Gloria June Nuckles, the other subscribing witness thereto, all three being present together at the same time, and that she, the said Emma Mabe, and Gloria June Nuckels signed their names thereto as subscribing witnesses at the request of the said Sarah M. Shortridge and in her presence and in the presence of each other, all three being present together at the same time, and that in her opinion, the said Sarah M. Shortridge was of sound mind at the time thereof. MRS. BEATRICE REEDY
Mrs. Beatrice Reedy, age 54, wife of Virgil Reedy, a former resident of Richlands, having moved to New York less than a year ago, died in the Medical Center Hospital, New York City, Saturday, February 4th, following a lingering illness.

She was born at Cedar Bluff, daughter of John and Jennie Burress and had always lived in the communities of Cedar Bluff and Richlands.

Surviving other than her husband are four daughters, Mrs. Lila Marie Bales, Raven, Mrs. Nettie McClanahan, Mrs. Trula Osborne and Miss Violet Reedy of Richlands. Three sons, Virgil, Jr., Donald and Frank,
all of Richlands. Seven half-sisters, Mrs. Bill Whitt, Mrs. Virgie Harman of War, W. Va., Mrs. Henry Shortridge, Richlands, Mr. Molly Wolf, Big Auger, W. Va., Mrs. Cindy Waldron, and Mrs. James Hooker of Richlands and Mrs. Mary Quesenberry at Baptist Valley. Four half brothers, Jon Burress and Bud Burress of Baptist Valley, Raleigh and Newt Burress of Tazewell. Thirteen grandchildren and one great grandchild. The body arrived in Richlands Tuesday by train and was taken to Hurst-Scott Funeral Home. Funeral services will be Thursday at 2 p.m. from the Richlands Tabernacle with Rev. A. B. Williford and Rev. Lee McGlothlin officiating. Burial in Hankins cemetery.

Survivors in addition to her husband include one son, Louie Wade Jennings; two daughters, Pamela Sue and Betty Louise Jennings; two brothers Vernon Burress of Marietta, Ohio, Lloyd Burress, of Portsmouth; and one sister Mrs. Virginia Whitman of North Tazewell. 1921 Cedar Bluff; Last Saturday the remains of Roscoe PACK, who was killed in France, arrived here from Hoboken, N.J. accompanied by a sergeant from Fort Washington, D.C. Mr. PACK was a son of Mr. and Mrs. John R. PACK, and was one of Tazewell County's soldiers being only seventeen years old when he enlisted, and was on of the Cedar Bluff boys who enlisted in the historic 2nd, Virginia Regiment while two companies or the regiment were stationed here on guard duty in 1917, at Camp McClullan, Alabama, he was transferred to Co. I, 116th Regiment, and was a private in that company overseas where he was killed while going "over the top" in the Argonne Forest offensive on October 15, 1918. Funeral services were conducted at the home of the Rev. J.E. LINKOUS. Interment was in charge of the Richlands Post of the American Legion

John Pack Jr. 15, was killed instantly early Thursday morning when a truck in which he and two more boys were riding overturned near Bust Head & pinned young Pack underneath. He the youngest son of John Pack of Baptist Valley and leaves an older brother, Brooks, and three sisters. Funeral services were held at the home place Saturday, at 2:30 PM.
